<br />433 CITY COUNCIL MEETING MINUTES <br />434 OCTOBER 12, 1994 <br />435 PAGE NINE <br />436 <br />437 appeared to feel that the city Council should, at a minimum, when <br />438 made aware of a boulevard improvement, notify the property owner <br />439 and have them sign a hold harmless agreement. Mr. Hellings <br />440 appeared to feel this would lessen any possible city liability. <br />441 If the property owner moves, at least the City would have <br />442 something on file demonstrating that the City did attempt to <br />443 address the issue. <br />444 <br />445 Motion by Dario, second by Wilharber to direct City staff to <br />446 draft a hold harmless agreement indemnifying the City of <br />447 centerville from any liability which could result from a <br />448 boulevard improvement; <br />449 a letter shall be sent notifying property owners that <br />450 boulevard improvements are prohibited; <br />451 should the property owner wish to retain the boulevard <br />452 improvement, the property owner must sign a hold <br />453 harmless agreement indemnifying the City of Centerville <br />454 from any liability which could result from such <br />455 boulevard improvements; <br />456 the City Attorney shall review the letter and hold <br />457 harmless agreement, <br />458 motion carried unanimously. <br />459 <br />460 PETITIONS AND COMPLAINTS: <br />461 <br />462 MSA Consulting Engineers - 7173 Grangeview. <br />463 The City Council reviewed a complaint from Colleen Cannon, 7173 <br />464 Grangeview, regarding MSA Consulting Engineers. A copy of this <br />465 complaint is attached to and made a part of these minutes. <br />466 <br />467 Dave Nyberg, MSA Consulting Engineers, was present. Mr. Nyberg <br />468 apologized for the tone of the September 28, 1994 meeting. Mr. <br />469 Nyberg suggested that at the next informational meeting, the City <br />470 does not waste time explaining the scope of the project. It <br />471 appears the citizens would like to have the meeting opened to <br />472 address their questions. Mr. Nyberg noted he will do his best to <br />473 address resident questions and to present the answers in a good <br />474 tone. Mr. Nyberg also expressed he will present information in <br />475 less technical terms. <br />476 <br />477 Motion by Buckbee, second by Wilharber to direct City staff to <br />478 draft a letter apologizing for the tone of the information <br />479 meeting held on September 28, 1994; <br />480 explaining that this is an important issue and that in <br />481 the near future they will be notified of the next <br />482 meeting to be held on November 1, 1994; <br />483 the letter will be sent to all persons who attended the <br />484 informational hearing, <br />485 motion carried unanimously. <br />486 <br />
