Council member Helmbrecht noted centerville <br />330 Elementrary needs a lot of help and she is personally going to <br />331 fight for the help it needs. <br />332 <br />333 Boulevard Improvements. <br />334 The City Council reviewed a letter dated September 8, 1994 from <br />335 Greg Hellings, City Attorney, regarding boulevard improvements. <br />336 A copy of this letter is on file with the Clerk/Administrator. <br />337 <br />338 Council member Brenner expressed she felt the City should not do <br />339 anything regarding the placement of boulevard improvements. <br />340 Council member Brenner expressed, in her opinion, the City does <br />341 not have an ordinance regulating boulevard improvements. <br />342 <br />343 Sanna Buckbee, Acting Clerk/Administrator, noted the City <br />344 Attorney advises in his letter that the City may create a greater <br />345 liability for itself it chooses to regulate boulevard <br />346 improvements and then fails to fOllow-up on improvements. Mr. <br />347 Hellings noted that if somebody was injured by a boulevard <br />348 improvement which was brought to the city's attention, for which <br />349 the City should have known about, but failed to act upon, the <br />350 City could possibly be held liable. Several boulevard <br />351 improvements have been brought to the attention of the City, <br />352 therefore it create a greater liability for itself. <br />353 <br />354 Mayor Buckbee noted Mr. Hellings noted the City could choose to, <br />355 at a minimum, have the property owner sign a hold harmless <br />356 agreement indemnifying the City of centerville from any liability <br />357 which could result from boulevard improvements. Mayor Buckbee <br />358 questioned what happens to the hold harmless agreement after the <br />359 owner who signs it moves. <br />360 <br />361 Motion by Buckbee, second by Brenner to direct City staff to <br />362 investigate if the City of Centerville currently has a policy <br />363 regarding placement of boulevard improvements; <br />364 to request the City Attorney's opinion if a hold <br />365 harmless agreement can be filed with the property <br />366 owners deed; <br />367 and to present the information to the City Council at <br />368 the next appropriate City Council meeting, <br />369 motion carried unanimously. <br />370 <br />371 Update on Projects being Performed by Tamara Miltz-Miller. <br />372 The City Council reviewed a pending projects update dated <br />373 September 27, 1994 from Tamara Miltz-Miller. A copy of this <br />374 information is on file with the Clerk/Administrator. <br />375 <br />376 Council member Brenner expressed concern with the estimated <br />377 Capital Improvement Plan completion date. The Star City <br />378 Committee needs this project completed for its application <br />
