The purpose of the special <br />workshop meeting was with regard to the Centervi1le Flood Plain <br />Reduction project. Mayor Buckbee called the meeting to order at <br />5:40 p.m. Present: Brenner, Dario, Helmbrecht, Wilharber. <br /> <br />It was noted Greg Hellings, City Attorney, is drafting a document <br />to rescind the petition submitted by the City of Centerville to <br />the Rice Creek Watershed District. Mr. Hellings is also working <br />with the Rice Creek Watershed District Attorney with regard to <br />the Joint Powers Agreement. <br /> <br />MSA, Consulting Engineers is preparing the new permit for <br />submittal to the Rice Creek Watershed District. <br /> <br />John Stewart, City Engineer, was present. Mr. Stewart noted the <br />plans and hydrology are being updated. The permit application is <br />scheduled to be submitted by December 12, 1993 with a bulk of the <br />data and hydrology. A letter will also be submitted with the <br />permit stating more data will be sent under separate cover. <br /> <br />Mr. Stewart noted the survey of properties for the Peltier Lake <br />Drive culvert easements is 99% complete. Mr. Stewart noted he <br />will prepare an Peltier Lake Drive culvert easement exhibit by <br />December 29, 1993. <br /> <br />Clerk/Administrator Tamara Miltz-Miller noted that she spoke with <br />Kate Drewry from the Rice Creek Watershed District on Friday, <br />November 18, 1993. Ms. Dreary informed Ms. Miltz-Mil1er the Rice <br />Creek Watershed District neglected to inform the City of <br />Centervi11e about a policy regarding easement acquisition. It <br />appears it is the policy of the Rice Creek Watershed District to <br />obtain easements either side of the ditch. It appeared to be the <br />opinion of Ms. Drewry that the Rice Creek Watershed District <br />would not be responsible for the cost of obtaining the easements. <br /> <br />Mr. Stewart noted the City appears to have two options that can <br />be utilized to access the ditch. Obtain property easements or <br />the property owner's could be asked to sign a wavier of trespass <br />to perform ditch maintenance. The City also has the authority to <br />obtain the easement areas through condemnation proceedings. <br /> <br />Mayor Buckbee asked when does the City cut its losses and abandon <br />the project. Mayor Buckbee voiced frustration with the <br />additional costs incurred due to delays. The project has already <br />been reviewed by the Engineers and the Attorneys. Mayor Buckbee <br />expressed the Rice Creek Watershed District has not been <br />productive in the process of the project. <br />
