AMENDED AND RESTATED JOINT POWERS POLICE DEPARTMENT CONTRACT CITIES OF CENTERVILLE, CIRCLE PINES AND LEXINGTON MINNESOTA This contract is entered into this 1 st day of January 2004, by and between the City of Centerville, hereinafter referred to as "Centerville," and the City of Circle Pines, hereinafter referred to as "Circle Pines," and the City of Lexington hereinafter referred to as "Lexillgton", all municipal corporations located in the State of Minnesota, COUllty of Anoka, sOlnetimes hereinafter referred to collectively as "member cities". WHEREAS, Centerville, Circle Pines and Lexington desire to establish, equip and operate a jOillt powers police department to protect, safeguard al1d furnish police protection for their citizens pursuant to Mimlesota Statutes Section 436.06, and WHEREAS, the parties Ilereto desire to establish a Board of Police Comnlissioners pursuant to the authority of Mimlesota Statutes Section 436.06, Subd. 2, hereinafter referred to as the "Governillg Board" to control and supervise tIle administration of tIle joint police department. NOW, THEREFORE, IT IS HEREBY AGREED as follows: SECTION I GENERAL PURPOSE The purpose of this agreel1lel1t is to l1lail1taill an orga1lization to jOil1tly and cooperatively provide community policillg tIlat focuses 011 cri11le and disorder through the delivery of police services that includes aspects oftraditiollallaw enforcemellt, as well as prevel1tion, problem solving, con1munity ellgagelne11t and palillersIlips. The area to be serviced is tIle corporate linlits of the member cities. SECTION II DEFINITIONS 2.1 Departme11t: Departlnellt is tIle police department created by tI1is agreelTIellt for the purpose of providing police protectio11 services. 2.2 Fil1ancial Accou11ting: Financial accoulltillg illcludes preparation of repolis, bill lists alld audits for the purpose of providing a depiction of the finallcial status of the departmellt. 2.3 Fina11cial Default: Fina11cial default occurs when allY lnelnber is more than 90 days overdue for its lTIontI1ly paymellt to tIle depalinlent. 2.4 Non-Budgeted Expenditures: Non-budgeted expenditures are expe11ditures not listed in the agreed upon budget and/or expenditures ill excess oftlle agreed upon budget. 2.5 Rules and Regulations: Rules and regulations are the policies and procedures adopted by the Governing Board governing the action of the Governing Board and its employees. - 1 -
