<br />b) The increase in the most restrictive levy limit applicable to the budget year placed on <br />any of the member cities over the levy lilnit for that n1ember municipality for the prior <br />year. <br /> <br />In the event (a) or (b) decreases, the operating budget shall remain the same. <br /> <br />SECTION X <br />DISPUTE <br />RESOLUTION <br /> <br />10.1 Dispute Process. WI1enever there is a disagree111ent betweell tIle lllelnber cities as to the <br />meaning or applicatioll of any of the terms hereunder, or as to the respective rights, powers, <br />duties and obligatiolls of tIle lnember cities, and the disagreement cannot be resolved, the parties <br />sIlall engage in a dispute resolution process as follows: <br /> <br />a) A member city initiating the dispute resolutioll process sI1all forward a written <br />state111ent of tIle dispute to a regular or special ll1eeting of the Goven1ing Board. The <br />Govemi11g Board shall have six (6) lnollths to resolve tIle dispute. <br /> <br />b) If tIle dispute is l10t resolved as provided for ill Section 1 O( a), tIle matter sIlall be <br />forwarded to tIle A110ka County Mediation Service or if A110ka County Mediatioll <br />Service is unavailable, SUCll otller 111ediatioll service as detemli11ed by the Govenling <br />Board. TIle mediatioll service sl1allIlave nillety (90) days to resolve tIle dispute. <br /> <br />c) If the dispute is not resolved as provided for ill Section 10(a) alld 10(b), tI1en upon a <br />111ajority vote of the melnber cities, tIle dispute s11all proceed to arbitratio11 as provided <br />for ill Section X oft11is Agreelnellt. <br /> <br />SECTION XI <br />ARBITRATION <br /> <br />11.1 Arbitration Procedures. <br /> <br />a) Arbitratio11 sIlall be conducted by and ul1der the cOl11111ercial arbitration rules of tIle <br />A111elica11 Arbitration Association, and shall be c011ducted by a sillgle arbitrator. <br /> <br />b) WitIlin tIlirty (30) days after the appointlllellt of tIle arbitrator and no S0011er than ten <br />(10) days following writtell110tice to the member cities, tI1e arbitrator shall cormnence a <br />hearing 011 tI1e dispute. <br /> <br />c) The Ilearings sI1all be open to the public, recorded and may be tra11scribed at tI1e request <br />and expense of a11Y member city. <br /> <br />- 8 - <br />
