<br />Pursuant to due call and notice thereof~ the City of Centerville <br />City Council held a public hearing on the proposed assessment of <br />the 1987 Street Reconstruction Project on Wednesday~ September 9, <br />1987 at the Centerville Elementary School Cafeteria. Mayor <br />L'Allier called the meeting to order at 7:10 p.m. Present: <br />Fritchie, Wilharber, Laska, Neumann. <br /> <br />Terry Mauer, City Engineer <br />regarding the 1987 Street <br />information sheet is attached <br />minutes. <br /> <br />presented written information <br />Reconstruction Project. That <br />to and made a part of these <br /> <br />Felix Mannella, Attorney at Law spoke stating that he represented <br />83 homeowners with regard to assessment appeals. Mr. Mannella <br />asked several questions of City Engineer regarding details of the <br />planning and reconstruction of the streets involved in the 1979 <br />Street Restoration Project and 1987 Street Reconstruction <br />Project. <br /> <br />William Hawkins, City Attorney advised that the questioning was <br />beyond the scope of the hearing. Mr. Hawkins advised that the <br />only purpose of the hearing was to answer questions to the amount <br />of the assessment to individual property owners. He also <br />recommended that the City Council not use the advisory method <br />attempted by Mr. Mannella. <br /> <br />Per the recommendation of City Attorney, Mayor L'Allier ruled <br />Felix Mannella out of order in his attempt to use the hearing in <br />advisory method. <br /> <br />Mr. Mannella presented written objections to the 1987 Street <br />Reconstruction Project. Those objections are on file with the <br />City Clerk. Mr. Mannella requests that the City Council adjourn <br />the hearing and settle the appeal with the 83 property owners <br />that he represents in arbitration. <br /> <br />Jerry McKensie an appraiser in White Bear Lake appeared before <br />the Council to advise that he did not feel that the value of the <br />properties involved in the 1987 Street Reconstruction Assessment <br />would increase more than $500.00 to $1,000.00 due to the <br />reconstruction. <br /> <br />John Anderson, 6933 Pheasant Lane expressed concern that he has <br />been assessed 100% on the long side of his corner lot. He <br />requests that the current assessment be lowered or that a City <br />policy be made to guarantee that when the street on the short <br />side of his property is reconstructed, he will not be again <br />assessed 100%. Mr. Anderson's written appeal is attached to and <br />made a part of these minutes. <br /> <br />City Engineer and City Attorney agree that a City policy should <br />be adapted regarding this, so that future Councils will follow <br />through with appropriate assessments for all corner lots. The <br />City Council will do so at a future meeting. <br />
