<br />-1- <br /> <br />SECTION IX. MuzzlinR. Whenever the prevalence of rabies renders <br />such action necessary to nrotect the nublic health and safety, the <br />Mayor shall issue a proclamation ornering every per~on owning or <br />keeping a dog to confine it securely on his nremises unless it is <br />muzzle~ ~o that it cannot bite. No nerson ~hall violate such <br />proclamation, and any do~ runnin~ ~t 18rge during the time fixed <br />in the proclamation may be destroye~ by the Dolice without notice <br />to the owner. <br /> <br />SECTION X. Vici01.1!=: Animal s. '''henever the Chief of Police or City <br />Health Officer determines that any dog, cat or other animal has <br />bitten any person, such animal ~hall be deemed to be vicious for the <br />purpose of this section. Such animal may be impounded in the City <br />pound for a neriod of ten days or more at the expense of the owner <br />of said animal. Except for the time limit, disnosition and redemp- <br />tion shall be in accordance with nara~raDhs Band D of Section VII. <br />The quarantine required by this ~ection shall not be necessary and <br />the requirements shall be waived whenever the owner of such dog or <br />animal, immediately upon receipt of the notice referred to above <br />presents to the Centerville Police the certificate of an authorized <br />veterinarian that the do~ or animal was vaccinated for rabies on a <br />date less than one yeRr prior to the date of ~uch notice. <br /> <br />SECTION XI. Summary Destruction of Certain Do~s. Whenever an <br />officer has reasonable cause to believe that a narticular dof. <br />pre8ents a clear an~ immeniate rl~nger to residents of the City <br />becau~e it i~ infectprl with r~bies or becau!=:e of a clearly demon- <br />strated vicious nature, the officer after makinF reasonable attemnt~ <br />to imnounrl ~uch dog', may summarily r1estroy said dog. <br /> <br />SECTION XII. Kennels. No person shall keep more than two dogs over <br />six months oln without obtaining a kennel license. The kennel <br />license is required in addition to the in~ividual dog licenses. <br />The City rouncil shall issue a kennel license unon the fOllowing <br />conditions which sh~ll be af;reen to by the licensee: <br />1. Payment of an annual kennel license fee in the amount <br />of t25.00. Kennel licenses shall expire on December 31 <br />of each year ann must be renewed. <br /> <br />? Kennels and the premises used therefore shall be kent in <br />a clean, quiet, orderly ann sRnitary conrlition, so as <br />not to con~titute a nuisance as defined in Minnesota <br />Statute 5hl.Ol. In netermining whether a nuisance <br />exists, consideration ph~ll be given to the kennel's <br />location, location of other residents and the general <br />character of the nei~hborhood. <br /> <br />3. All such dog~ in exce~s of two shall be at all times <br />confined in a building or enclosure or under control <br />by a leash or otherwise under control. <br /> <br />4. Comnliance with provisions of the City Zoning Code. <br />
