Dennis and I had one new abstract made up from the old one. (this <br />last month) so each family would have an abstract. We also had title <br />opinions done on each abstract (as required by the builder). These <br />are back now and they are only good for )0 days. <br /> <br />When the abstracts were continued. St. Paul Title Co in Anoka, put <br />in them, an ordinance #2IA. This was entitled: An ordinance estab- <br />lishing regulations for the subdivision and platting of land within <br />the village of Lino Lakes. I have attached this ordinance to this <br />statement. I checked with Char at Burnet Realty's closing dept. about <br />this. She called St. Paul Title in Anoka and they told her that it <br />was a mistake (the ordinance) and that they would remove it. St. <br />Paul Title Co of Anoka also informed her that they could not find <br />any ordinance at all concerning subdivision of land in Centerville <br />or any other item relating to land size. We would like to know <br />where we can get a copy of any ordinances that pertain to Centerville's <br />building restrictions. Another question we had was how or why did <br />the Title Company figure that Lino Lakes ordinances are a part of <br />Centerville.s? <br /> <br />7. OUR PROBLEM IS THIS: <br />On August 16th I stopped by Mrs. Prachar's house to see if there were <br />any assessments for our property. I showed her the plat map of the <br />area of the property. Mrs. Prachar said to me "you can't build <br />here. It Then she went on to tell me tha t the land must have been <br />platted into the 2t acres before April. The new ordinance (?) was <br />that any area without city sewer cannot have any more then one <br />house per 10 acres. This, she said. went into effect in April. Mrs. <br />Prachar told me that they decided to go along with the Metro Council's <br />requirements. I asked why didn't the building inspector know about <br />this? I was told that he must not have been up to date on this new <br />requirement. I wonder also why Mrs. Prachar didn't mention this to <br />us when we talked to her originally in June. I talked to Mayor <br />Prachar that same night. He told me that the building inspector <br />was confused. He also said that this new requirement was not <br />publicized and got around by word of mouth. We have put alot of <br />money and time into this. We did everything in good faith. We <br />feel that we have been misled if what I have said about one house <br />for ten acres outside sewered areas is true. The building inspector <br />was misinformed or not informed of this change and we went by his <br />word because he was the building inspector and we were directed to <br />him by the city clerk. We are aSking for a variance so we can go <br />ahead with our plans. It was not our fault, we checked the require- <br />ments that we were suppose to. We filled the requirements that were <br />given to us. The next page is the amount of loss we have if we are <br />unable to go through with our plans. The mayor advised us to bring <br />our case to the council meeting. Maybe the council can help us out. <br /> <br />~ <br />
