On June 7, 1977, Dennis & Wendy Zerwas and Donald & Mary Zerwas, <br />signed separate purchase agreements to purchase 2i acres each, of <br />the 5 acres that Ken Carpenter was selling through Burnet Realty. <br /> <br />2. That same week, Wendy Zerwas called Mrs. Prachar to inquire about <br />building requirements and minimum building size of the land. She <br />gave me the name and phone number of building inspector, Gene Mobley, <br />and told me to talk to him. I told Mrs. Prachar our intentions and <br />the area we were planning on building. I asked about sewer assess- <br />ments for that area and I was told that the sewer system would only <br />go down to the dirt road and no farther. (private development) The <br />land is just south of that road. She said it would be at least 20 <br />years until they continued sewer down that road. I was not told <br />of any other ordinance on size of building site. Dennis Zerwas <br />called and talked to Mrs. Prachar soon after that and got this <br />same information about the area. <br /> <br />3. That same day I talked to Mrs. Prachar, I talked to Mr. Mobley <br />on the phone. He told me that the minimum land requirement was 2i <br />acres and the minimum sq. foot of the house was 1000 sq ft. He to~d <br />this same information to Mary Zerwas, when she called him. My <br />husband, Dennis, and our builder, Bob Heck also talked to Mr. Mobley. <br />Each was given the impression that we were going to be able to build. <br />We each had 2i acres and our houses are 1008 sq ft. We got a buildable <br />perculation test. This was done on July 16th. I took the results <br />of our perc test to Mr. Mobley on July 18th, and he said that at a <br />rate of )0 min (for perc test) we are going to need 250", per bedroom <br />or a total of 750' of drain field. I told him that my in-laws perc <br />test was completed but I did not have the report on it yet. Their <br />perc test came out to be )0 minutes also. I then obtained a bid for <br />our septic system. I also asked Mr. Mobley if there was any cost <br />involved in splitting 5 acres in half. He said no there was not. <br />(I was told to check on this by our builder who said that some areas <br />have a cost to split acreage.) Mr. Mobley knew where we were planning <br />to build because he told my husband and I that he had driven past the <br />property and had seen the.men doing the perculation test on it. He <br />wanted to make sure that we knew that the perculation tests must be <br />taken where we were planning to build our houses. This first perc <br />test was ordered by Mr. Carpenter. They did the tests in the middle <br />of the property. When we found this out we ordered our own perc tests <br />on the areas that we planned to put our houses. We also had a survey <br />done of the property for our mortgage co. One final word on Mr. Mobley. <br />I myself talked to him a few more times during the last 2 months and <br />nothing was said of this ordinance of one house per 10 acres. <br /> <br />4. Dennis and Wendy's mortgage was approved on Au~ust 9. We have the <br />6i% interest mortgage with a total sales price of '37,500. If we are <br />delayed to much, costs may go up and put us out of this price. Our <br />appraisel came out good. Our builder buys the property and then puts <br />it in our mortgage.
