Pursuant to due call and notice thereof the City Council of the City of Centerville held their regular meeting on Monday, December 23, 1991 at the City Hall. Mayor Buckbee called the meeting to order 7:03 p.m. Present: Burgstahler, Pelton, Wilharber. Absent: Daria. OLD BUSINESS Results of the Peltier Lake Drive Petition for Water Survey Motion by Burgstahler, second by Pelton to direct the Clerk/Administrator to send a letter to the recipients of the Peltier Lake Drive Petition for Water Survey and summarize the results of this survey; the letter shall e~plain that at this time the City of Centerville does not intend to e~tend municipal water to the north and west until there is a need; the letter shall also e~plain that when this occurs there are several routes to be considered; if and there would be a need for a municipal water extension the City shall re-contact the resident regarding further input on the route that the City shall use, motion carried unanimously. Center Oaks Ditch Mayor Buckbee updated the City Council regarding the possibility of alleviating a drainage concern on Lot 16, Block 1, Center Oaks I. Mayor Buckbee advised that he had met with the Clerk/Administrator and Russell Almendinger to re-discuss the possibility of putting a ditch on his property to facilitate drainage. Mr. Almendinger advised that he would install the ditch on two conditions: 1. The City give him in writing a Release of Liability for the ditch; and 2. That the City scrape down a IIhumpll on the north Center Oaks I drainage easement area. It may still be possible for Mr. Almendinger to construct the ditch yet this year however, the later it gets the less chance this can be accomplished. The City Attorney has advised that a Release of Liability to Mr. Almendinger may be reasonable. Motion by Burgstahler, second by Wilharber to authorize the Clerk/Administrator and the Mayor Buckbee, on behalf of the City of Centerville, to enter into an agreement with Russell Almendinger regarding a Release of Liability as a result of the construction of a drainage ditch on his property between the area of Lot 16, Block 1 and Lot 12, Block 1, Center Oaks I Development for the increase in flow of water due to the construction of said drainage way;
