<br />City Council Meeting Minutes <br />December 11, 1991 <br />Page Fotlr <br /> <br />Henderson Ditch - Center Oaks I <br />Mayor Buckbee summarized the Hendersontditch/drainagetconcer~. <br />Mayor Buckbee noted that Russell Almend1nger has resclnded h16 <br />offer to assist the City by digging a ditch on his property to <br />help the drainage in the Center Oaks I development due to <br />complaints/concerns expressed by Dan Tourville and Beverly <br />Htlg}les . <br /> <br />It was noted that the City Engineer was investigating the digging <br />of a temporary holding pond (this winter) in the easement area to <br />hold some of the water. <br /> <br />It appeared to be the consensus of the City Council members <br />present that if the water from the temporary holding pond was to <br />be pumped into the street that this could create a hazardous <br />s i t.l18. t, ion. <br /> <br />Council member Burgstahler noted that Greg Hellings, City <br />Attorney, had advised that it is the City~s responsibility to <br />alleviated the drainage situation on the Henderson property. <br /> <br />D H d 18~h n ter ~t~e-et w~s nre_.se-.nt. " C.U..l r .... <br />noted that a solution needs to be found and questioned as to what <br />the City's long term goal is. <br /> <br />Mayor Buckbee noted that in discussions with John Stewart~ City <br />Engineer, it was noted that the private ditch on the west slde~of <br />Centerville Road needs to also be cleaned. This would requlre <br />the property owners permission. <br /> <br />Council member Pelton noted that there is presently no funding to <br />pay for the cleaning of the ditch. The City will also need to <br />work out an easement agreement with the property owners. <br /> <br />Council member Burgstahler noted that Mr. Almendinger had ag:eed <br />to dig a ditch and the City was to clean the ditch to Centervllle <br />Lake, objections were raised and Mr. Almendinger backed out. T~e <br />snow came, and the temporary solution of digging a sump hole In <br />Mr. Henderson's back yard has come about. <br /> <br />Dan Tourville, 6994 Centerville Road, was present. Mr. To~rvil~e <br />noted that he would question the legality of Mr. Almendlnger s <br />draining of water from one property on to other properties. Mr. <br />Tourville stated that Mr. Almendinger will also benefit fro~ the <br />draining of water off of his property. The water should dral~ t~ <br />Centerville Lake. The culvert is obstructed under Centervllle <br />Road. The most critical, in Mr. Tourville~s opinion, is the <br />cleaning of the ditch west of Centerville Road. <br /> <br />I <br /> <br />I <br /> <br />I <br /> <br /> <br />Council member Pelton noted that Linda Drilling, Park and <br />Recreation Committee member, had called to find out what the City <br />Council approved for a budget amount for 1992. <br /> <br />City Council Meeting Minutes <br />December 11, 1991 <br />Pa.ge Six <br /> <br />Sorel Street Drain Tile <br />Motion by Burgstahler, second by Wilharber to authorize City <br />Staff to send a letter to the Minnesota Pollution Control Agency <br />outlining the City of Centerville's attempts to locate a sewage <br />source in a private drain tile and request assistance to resolve <br />the issue, motion carried unanimously. <br /> <br />Proposed Flood Plain Reduction - Amended Petition <br />Motion by Pelton, second by Burgstahler to approve the amended <br />petitions for improvements for the proposed flood plain reduction <br />for consideration by the Rice Creek Watershed District, motion <br />carried unanimously. <br /> <br />Motion by Pelton, second by Burgstahler to adopt Resolutions #91- <br />and Resolution #91- authorizing petitions to the Rice Creek <br />Watershed District for the Clear Water Creek Flood Plain <br />Reduction Project, motion carried unanimously. <br /> <br />Publication of Article Focusine on Centerville in the "Northern <br />Lights" magazine <br />Mayor Buckbee requests that City Staff investigate when the <br />article featuring Centerville is planned for publication. It <br />appeared to be the consensus of the City Council members present <br />that this article was to be published some time ago. <br /> <br />PETITIONS AND COMPLAINTS <br /> <br />Mayor Buckbee noted that he had received a complaint from John <br />Nyhus, 1970 Cardinal Drive, that the snow was 10 to 12 feet from <br />llis rrjailbox. <br /> <br />Walt Neumann, 1989 South Robin Lane, was present. Mr. Neumann <br />noted that there is no place to put the snow. Mr. Neumann stated <br />that he recalls that the snow was approximately 4 feet from the <br />rrJa i 1 l:>() X . <br /> <br />OLD BlJSINESS <br /> <br />Snow Plow Task Force Meeting <br />Council member Wilharber noted that the Task Force will be <br />meeting on Saturday, December 14, 1991 to discuss snow plowing. <br />Council member Wilharber will update the City Council at the next <br />appropriate meeting. <br /> <br />PETITIONS AND COMPLAINTS <br />
