City Council Meeting Minutes December 11, 1991 Page Fotlr Henderson Ditch - Center Oaks I Mayor Buckbee summarized the Hendersontditch/drainagetconcer~. Mayor Buckbee noted that Russell Almend1nger has resclnded h16 offer to assist the City by digging a ditch on his property to help the drainage in the Center Oaks I development due to complaints/concerns expressed by Dan Tourville and Beverly Htlg}les . It was noted that the City Engineer was investigating the digging of a temporary holding pond (this winter) in the easement area to hold some of the water. It appeared to be the consensus of the City Council members present that if the water from the temporary holding pond was to be pumped into the street that this could create a hazardous s i t.l18. t, ion. Council member Burgstahler noted that Greg Hellings, City Attorney, had advised that it is the City~s responsibility to alleviated the drainage situation on the Henderson property. " C.U..l r .... noted that a solution needs to be found and questioned as to what the City's long term goal is. Mayor Buckbee noted that in discussions with John Stewart~ City Engineer, it was noted that the private ditch on the west slde~of Centerville Road needs to also be cleaned. This would requlre the property owners permission. Council member Pelton noted that there is presently no funding to pay for the cleaning of the ditch. The City will also need to work out an easement agreement with the property owners. Council member Burgstahler noted that Mr. Almendinger had ag:eed to dig a ditch and the City was to clean the ditch to Centervllle Lake, objections were raised and Mr. Almendinger backed out. T~e snow came, and the temporary solution of digging a sump hole In Mr. Henderson's back yard has come about. Dan Tourville, 6994 Centerville Road, was present. Mr. To~rvil~e noted that he would question the legality of Mr. Almendlnger s draining of water from one property on to other properties. Mr. Tourville stated that Mr. Almendinger will also benefit fro~ the draining of water off of his property. The water should dral~ t~ Centerville Lake. The culvert is obstructed under Centervllle Road. The most critical, in Mr. Tourville~s opinion, is the cleaning of the ditch west of Centerville Road. I I I Council member Pelton noted that Linda Drilling, Park and Recreation Committee member, had called to find out what the City Council approved for a budget amount for 1992. City Council Meeting Minutes December 11, 1991 Pa.ge Six Sorel Street Drain Tile Motion by Burgstahler, second by Wilharber to authorize City Staff to send a letter to the Minnesota Pollution Control Agency outlining the City of Centerville's attempts to locate a sewage source in a private drain tile and request assistance to resolve the issue, motion carried unanimously. Proposed Flood Plain Reduction - Amended Petition Motion by Pelton, second by Burgstahler to approve the amended petitions for improvements for the proposed flood plain reduction for consideration by the Rice Creek Watershed District, motion carried unanimously. Motion by Pelton, second by Burgstahler to adopt Resolutions #91- and Resolution #91- authorizing petitions to the Rice Creek Watershed District for the Clear Water Creek Flood Plain Reduction Project, motion carried unanimously. Publication of Article Focusine on Centerville in the "Northern Lights" magazine Mayor Buckbee requests that City Staff investigate when the article featuring Centerville is planned for publication. It appeared to be the consensus of the City Council members present that this article was to be published some time ago. PETITIONS AND COMPLAINTS Mayor Buckbee noted that he had received a complaint from John Nyhus, 1970 Cardinal Drive, that the snow was 10 to 12 feet from llis rrjailbox. Walt Neumann, 1989 South Robin Lane, was present. Mr. Neumann noted that there is no place to put the snow. Mr. Neumann stated that he recalls that the snow was approximately 4 feet from the rrJa i 1 l:>() X . OLD BlJSINESS Snow Plow Task Force Meeting Council member Wilharber noted that the Task Force will be meeting on Saturday, December 14, 1991 to discuss snow plowing.
