<br />City of Centerville <br />September 24, 2003 <br />Council Meeting Minutes <br /> <br />Motion bv Council Member Broussard Vickers. seconded bv Council Member <br />Capra to approve the 2004 bud2et for the Centennial Fire District. All in favor. <br />Motion carried unanimously. <br /> <br />2. 7016 and 7020 Brian Court (Prooertv Line Dispute) <br /> <br />Mr. Jerry Carlson, 7020 Brian Court, indicated that Ms. Jarosz was told this matter was a <br />civil issue and he does not understand why Staff is not handling a basic code issue. <br /> <br />Ms. Moore-Sykes indicated that this was initially a lot line dispute. <br /> <br />Mr. Carlson asked where Staff got that information because that is not the issue. He then <br />said he made a complaint because his neighbor's shed is 36 3/8 inches off the property <br />line and not the required 60 inches. He further indicated that there are benchmarks at the <br />comers. <br /> <br />Ms. Moore-Sykes indicated that the City received a survey from Mr. Carlson as requested <br />and Staffhas been reviewing the matter with the City Attorney as a lot line dispute. <br /> <br />Council Member Capra indicated she spoke to Ms. Jarosz concerning the matter and then <br />indicated the matter was left at bringing a survey to City Hall for Staff to verify and <br />measure from the irons. <br /> <br />Mr. Carlson indicated that both benchmarks are there and a line could be strung to make <br />the lot line determination. <br /> <br />Mr. Carlson indicated that Mr. Cook confIrmed that the shed is too close to the property <br />line. He then indicated he feels the shed is able to be moved and that is what he has <br />asked for. <br /> <br />Mr. Carlson indicated he has had problems with them and earlier this spring every day <br />someone was knocking on his door but 90 days have elapsed and nothing has been <br />resolved with his complaint. <br /> <br />City Attorney Hoeft indicated the survey provided does not help and said that an as built <br />survey for the other property indicating where the shed is located is needed. <br /> <br />Ms. Moore-Sykes indicated she looked in the property files and has nothing for the other <br />property but they maintain the shed was approved when they built it. <br /> <br />Council Member Broussard Vickers indicated the City needed to fInd out when the shed <br />was built. <br /> <br />City Attorney Hoeft indicated that he would need the survey to prove in court where the <br />shed is located on the property. He then indicated that Staff should look into whether <br />there is a drainage and utility easement that the shed is located in as well as what kind of <br /> <br />Page 3 off 4 <br />
