She indicated that part of her job is to keep track <br />of the special nesting places of the herons and egrets and noted that, of the nine colonies <br />in the metro area, only one colony is in Anoka County and that is the on the island in <br />Peltier Lake. <br /> <br />Ms. Galley indicated that the colony bas been on the island since 1982 and records show <br />that this colony formed because other rookeries fuiled. She further indicated that this <br />colony is the second largest colony of herons and egrets and that is why it is such an <br />important spot. <br /> <br />Ms. Galley indicated that the birds have fuiled to successfully nest the Jast two years and <br />the DNR wants to encourage the birds to stay by helping them to be able to nest <br />successfully this year. <br /> <br />Ms. Galley indicated that the data shows that these heron rookeries sometimes need a <br />buffer protection zone around them to keep them safe. She then indicated that there is a <br />complicating fi1ctor in this case because two cities share the Jake and have to agree to <br />submit the same ordinance to the DNR to make it possible. <br /> <br />Marty Asleson from the City of Lino Lak~ reiterated the comments of Ms. Galley <br />confirming that the herons and egrets nest as a colony on the island. He then conmented <br />that the task force believes that there is only one, or possibly two, more chances for the <br />birds to successfully nest on the island before they move the colony. He further <br />commented that it is the desire of the task force that residents along the Jake be notified <br />by mail prior to posting in the newspaper. <br /> <br />Council Member Capra commented that boat use would still be permitted south of the no <br />wake zone. Mr. Asleson cJari:fied that the ordinance would regulate use north of the no <br />wake zone and allow the Anoka Cowny Sheriff's Department to enforce the no wake <br />zone. He also noted that Anoka County would be putting in the markers to designate the <br />no wake zone. <br /> <br />Mr. LaBlanc indicated the task force was seeking approval to send the letter to residents <br />notifying them of the proposed ordinance and an authorization to set the matter for public <br />hearing on March 13, 2002 and again on March 27,2002. <br /> <br />Mayor Swedberg asked what was the best legal way to approach the matter. City <br />Attorney Hoeft indicated it would be fine for the City to authorize sending out the letter <br />because it does not obligate the City to anything. He then commented that he would <br />review the Joint Powers Agreement and proposed Ordinance. <br /> <br />Mayor Swedberg asked that the letter be printed on City letterhead. <br /> <br />Ms. Galley indicated that both cities would need to send out letters because there are Lino <br />Lakes' residents along the Jake as well as Centerville residents. <br /> <br />Page 3 of25 <br />
