<br />indicated that the Police Chief had attached a list to each of the licenses for failure to <br />disclose in 2000 as well as in 1999. <br /> <br />Council Member Broussard Vickers commented that, for whatever reason, Staff had not <br />reported that information last year. She then indicated that, had Staff done so, there <br />would not be a problem this year. She further commented that because she was operating <br />under the assumption that this would have happened last year she felt a fine was in order <br />because she felt business owners have the responsibility to follow the law and disclose <br />violations. <br /> <br />Council Member Broussard Vickers indicated that her motion to fine the license holders <br />was made based on incomplete information and wrong assumptions. <br /> <br />Motion by Council Member Broussard Vickers, seconded bv Council Member <br />Travis to reverse the 5500.00 failure to disclose {"mes issued to liQuor license holders <br />at the December 12, 2001 meetin2. <br /> <br />Council Member Capra disagreed saying that she feels the bar owners have a <br />responsibility to disclose violations. She then commented that, with the exception of Mr. <br />Sager, license holders were aware of the violations and did not disclose them. <br /> <br />Council Member Broussard Vickers indicated that she is concerned that the City is trying <br />to hold the license holders to a standard they were not held to in the past. <br /> <br />Council Member Capra noted she had spoken to Mr. DeFoe who had told her he wished <br />Centerville had its small town politics back where things could be resolved by sitting <br />down and talking about it rather than in a public format. She then indicated she had <br />informed him that it is against the open meeting law to do so. She further commented <br />that it is nice to have the small town feel but noted that rules need to be followed. <br /> <br />Council Member Nelson noted that in her business, if forms are not filled out correctly, <br />the IRS would fine and penalize her. She then commented that she does not feel that <br />filling out the form incorrectly for years is an excuse to continue to do so. <br /> <br />Council Member Travis indicated that he disagreed with Council in December when it <br />levied the fines. He then told the license holders in attendance that time is precious and <br />asked them not to waste any more of their time or Council time on this. He then said <br />"disclose the violations next time". <br /> <br />Mr. Montain indicated that if other administrations had told him about the procedure he <br />would have filled out the form correctly. <br /> <br />Mr. Ken Vanderbeek of 7095 20th Avenue South asked whether license holders should be <br />required to call the Chief of Police before filling out the renewal application to determine <br />whether they have had violations. <br /> <br />Page 8 of 24 <br />
