Mr. & Mrs. Mike Carter. 6913 Sumac Court - Appeal of Potentially Dangerous <br />Dog <br /> <br />This item was tabled until the August 27,2008, City Council Meeting. <br /> <br />VII. OLD BUSINESS <br /> <br />1. Res. #08-020 - Adopting Special Assessments - Old Mill Road Improvements - <br />(Tabled from Previous Meeting) <br /> <br />City Administrator Larson announced that, in the Council's packets, was another copy of <br />the Resolution. City Administrator Larson also passed out a list of the assessments that <br />have been adjusted after input from the City's appraiser. He stated that City Attorney <br />Glaser had provided the appraisal information. <br /> <br />City Attorney Glaser stated that they had one primary appraisal and then had a second <br />appraiser do additional work. <br /> <br />Councilmember Broussard-Vickers inquired about what happened with the appeal from <br />the last City Council Meeting. <br /> <br />City Attorney Glaser replied that he was surprised Ms. Cathy Fruth and Mr. Fred Fischer <br />were not in attendance at this City Council meeting. He stated that the Council can make <br />a decision at this time if it wishes to do so. If Ms. Fruth and Mr. Fischer appeal, the <br />Council could consider any additional information they provide and adjust the assessment <br />if appropriate. Ms. Fruth and Mr. Fischer have the option to take the issue on to District <br />Court. <br /> <br />City Attorney Glaser stated that Ms. Fruth and Mr. Fischer gave the Council "blanket" <br />reasons, but they did not give any "specific reasons." City Attorney Glaser stated that, <br />from his perspective, based on Ms. Fruth's and Mr. Fischer's appeal, the Council does <br />not have sufficient grounds to make a different decision. <br /> <br />Councilmember Paar stated that he knew City Engineer Statz and City Attorney Glaser <br />had both done their research on this matter. <br /> <br />City Attorney Glaser replied that Ms. Fruth and Mr. Fischer were preserving their right to <br />argue in front of a Judge. <br /> <br />Page 3 of9 <br />
