City of Centerville <br />City Council Meeting <br />August 13, 2008 <br />Mayor Capra stated that she talked to Commission Sivarajah. She pointed out that the <br />signs that are orange, with black lettering, indicate that there is an "automatic" double fine <br />in that area. <br />VII. OLD BUSINESS <br />L Ms. Cathy Fruth (7384 Old Mill Road) -Driveway Issue - (Old Mill Road <br />Improvements) - (Tabled from Previous Meeting <br />Mayor Capra inquired whether there were any updates on Ms. Fruth's driveway issue. <br />City Administrator Larson replied that the last they heard was that she needed time to <br />decide whether any of the Counsel's suggested solutions were acceptable. He added that <br />no one has heard back from her. <br />City Engineer Statz stated that Ms. Fruth's neighbor, Mr. Fischer`s, driveway was <br />recompacted and touched up a little. He recommended sending Ms. Fruth a letter stating <br />that, unless the City Council hears otherwise, they will assume this issue is settled. The <br />City would then go ahead and do touchups work. <br />Motion was made by Council Member Lee, seconded by Council Member Broussard- <br />Vickers, to send a letter to Ms. Fruth, stating that, unless the City Council hears <br />otherwise, they will assume this issue is settled. All in favor. Motion passed <br />unanimously. <br />2. Approve Joint Settlement Agreement -Sheehy Condemnation <br />City Administrator Larson stated that he had received an update from City Attorney Glaser <br />that the settlement amount was still at $ 201,500, but that some of the language in the <br />Agreement had been changed. <br />Motion made by Council Member Lee, seconded by Council Member Paar, to <br />reaffirm the approval of the Joint Settlement Agreement with Sheehy Condemnation. <br />Council Member Broussard-Vickers abstained. Motion carried (4/1). <br />VIII. NEW BUSINESS <br />1. Request for Reduction of Security (Letter of Credit) for Clearwater Creek Estates <br />Development - to $146,890, and Request for Refund of the $10,000 Escrow <br />Deposit <br />Mayor Capra requested that this issued be deferred to City Engineer Statz and City <br />Administrator Larson. City Administrator Larson stated that he is all right with it, as long <br />as there are no outstanding charges or bills. <br />Page 5 of 9 <br />
