This easement extinguishes old easements that are over much of the City and
Sheehy property replacing that with an easement of about 66 feet on the drainageway.
We still need to schedule an assessment hearing. Appraisal advice is being solicited in
order to prepare to specially assess the cost share to Sheehy.

Old Mill Road
We attended a Court hearing on November 10 regarding the assessment appeals from
Fruth and Fischer. The FruthlFisher's attorney requested a continuance in order to allow
them more time to get an appraisal to identify the benefit to their property. The hearing is
rescheduled to December 30, 2008.

2009 Street Improvement. You are scheduled for a work session to discuss the project
on December 1, 2008. We will supply you with a list of estimated assessments based on
the bid prices, in advance of that meeting.

Downtown.

Same. Beard has submitted application for the tax-credit project in Block 7 and continues
to work on Block 8 and the townhome portion on the east edge of the project area. It is
likely that nothing can begin before spring of 2009.

Paul Steffel has submitted a sketch plan for a building project on the property he still
owns at the northeast comer of the Centerville Road and Main Street intersection. Staff
will meet with him in early December to see what kind of assistance he might need to
move forward.

Same. We delayed bids for demolition of the property in Block 7, acquired from
Marshall. The Fire Department asked to use it for one more training exercise, but it
involved a bum and using water. That kind of training would be possible if any asbestos
is first removed. The buildings can be removed pretty quickly if all of the Beard pieces
come together and it hasn't yet been removed.

Trail grants. Mark Statz was authorized to do additional work on the trail project,
including field surveying and permit/environmental requirements. The surveyors were
not allowed on property owned by Ken Carpenter, where the proposed trail connects to
20th Avenue from the Center Street area.
