The business has already begun <br />operating without proper permits. This particular location abuts a residential zone, so <br />additional concerns are worth noting. <br /> <br />The applicant requests to operate a "automotive repair and storage" business. The <br />applicant has not provided a good description of how they intend to operate the business, <br />further the building they intend to operate in is part of a large site that also includes the <br />operation of construction-excavating business. Existing storage of tires, construction <br />materials and equipment on the site may harbor rodents and insect pests and is quite <br />unsightly when viewed from the residential areas to the north and west. <br /> <br />The City Code, section 154.060, D & E require landscape buffering and screening in <br />conjunction with a commercial use that adjoins a residential district. While the existing <br />construction business may predate these requirements, the city is within its power to <br />consider these measures as part of a conditional use permit for a new or changed use. <br />Thus, this application may provide an opportunity to correct some issues and conflicts <br />that exist in the current situation. <br /> <br />In considering the conditional use permit the Commission and Council may want to <br />consider any number of the following as well as others: <br /> <br />1) Clean up of the site to remove all tires, debris, equipment parts. <br />2) Remove the fence from the north property line and instead construct a screen and <br />buffer along the north property line in accordance with City Code Section <br />154.060 D. <br />3) Limits on the days and hours of operation. <br />4) Limits on the number of vehicles that can be stored on the site at anyone time. <br />5) Limits on the number of days that any vehicle may be stored on the site. <br />6) Prohibiting storage of tires and vehicle parts outside of the building. <br />7) Prohibiting storage of vehicles outside that are missing body parts. <br />8) Prohibiting storage of gas or other fuels on site and prohibiting any exterior <br />storage of containers of lubricants or other chemicals. <br /> <br />! ~ <br />
