City Council Meeting Minutes June 24, 1992 page seven Motion by Burgstahler, second by Dario that in event the foregoing motion is deemed unacceptable by the City Attorney the City Council adopts a Resolution to order a report by Maier, Stewart and Associates and directs staff to prepare appropriate notices for an improvement hearing for the municipal building water extension, motion carried unanimously. Motion by Pelton, second by Burgstahler to acknowledge receipt of the Plans and Specification for the Center Hills, Third Addition, the municipal building water extension and value work for the municipal tower and direct appropriate staff to advertise for bids for said project and set a bid date of July 17, 1992, 10:00 a.m., motion carried unanimously. Motion by Burgstahler, second by Buckbee to approve a Development Agreement for the Center Hills, Third Addition, contingent upon: Rice Creek Water Shed Permit; Final Plat being approved as acceptable by the City Council and Receipt of the appropriate escrows and fees for the development, motion carried unanimously. It appeared to be the consensus of the City Council to table discussion of the final plat of the Center Hills, Third Addition, at this time. Lot 1. Block 3 Peterson's Old Homestead Addition- Drainaqe/Gradina Council member Pelton advised that the drainage/grading correction provided by Howard Bohanon, Builder, on Lot 1, Block 3 Peterson's Old Homestead Addition, does not appear to be draining properly on the property to the east. She advised that the area does minimally meet drainage requirements, but is not the best situation. Vi Burston, 7164 Mill Road, mother of the owner of Lot 1, Block 3 Peterson's Old Homestead Addition, was present at the meeting. Motion by Wilharber, second by Pelton to direct City Staff to notify Howard Bohanon, Builder, in writing that the City is not happy with the project and that the City shall utilize the escrow monies submitted by Mr. Bohanon to improve the drainage/grading in the area, motion carried unanimously. Sump Pumo Ordinance Motion by Buckbee, second by Wilharber to table discussion of the Sump Pump Ordinance, motion carried unanimously.
