<br />City Council Meeting Minutes <br />June 24, 1992 <br />page six <br /> <br />Council member Wilharber inquired as to whether the City would be <br />liable if damage wereto occur when snow plowing. <br /> <br />John Stewart, City Engineer, advised that he would write into the <br />change order that the contractor would be responsible for City <br />damage related to plowing if the second course were to be allowed <br />to placed in the spring of 1993. <br /> <br />Motion by Burgstahler, <br />Stewart and Associates to <br />allow an extension until <br />course of the Center <br />Contracting, Inc., and <br />carried unanimously. <br /> <br />second by Buc~bee to authorize Maier, <br />prepare an appropriate change order to <br />the spring of 1993 for the final wear <br />Hills, Second Addition, by Ro-So <br />to approve said change order, motion <br /> <br />Ro-So Contracting, Inc. also requested a reduction in retainer. <br />The retainage is currently at 5%. Mr. Stewart advised that the <br />5% is typically held until the project is complete. <br /> <br />Motion by Buckbee, second <br />retainer currently be held <br />carried unanimously. <br /> <br />by Wilharber to not reduce the 5% <br />for Ro-So Contracting, Inc., motion <br /> <br />Center Hills - Third Addition <br />John Stewart, City Engineer, <br />for the Center Hills, Third <br />water extension. <br /> <br />presented Plans and Specifications <br />Addition and the municipal building <br /> <br />Motion by Burgstahler, second by Pelton to approve the municipal <br />building water extension along Main Street, and work on the water <br />tower to be joined with the Center Hills, Third Addition project, <br />motion carried unanimously. <br /> <br />Motion by Burgstahler, second by Pelton to not assess the <br />properties on the north side of Main Street for trunk facilities <br />(similar to the process that was completed on Mill Road); <br />at such time that the properties request to be hooked <br />up to City water the properties on the north side of <br />Main Street shall be charged a higher hook-up fee as <br />with the process on sections of Mill Road; <br />the reason for said decision is that the project is <br />undertaken to upgrade trunk main facilities and it may <br />be inappropriate for the properties on the north side <br />of Main Street (as it was inappropriate for certain <br />properties along Mill Road) to be assessed for <br />municipal water at this time; <br />the investment shall re-couped for lateral benefit at <br />such time that the properties request to be hooked up <br />to municipal water, <br />M@t!@n @afr!@d Uftan!m@uliv= <br />
