<br />City Council Meeting Minutes <br />June 8, 1992 <br />page six <br /> <br />gutter. <br /> <br />It was noted that a revised Final Plat has not yet been submitted <br />to the City and a Development Agreement has not been drafted. <br /> <br />It was noted the City Attorney has been consulted and he advises <br />he is not comfortable going out of sequence for the project as it <br />would set precedent for other developments. <br /> <br />It was also noted it appears reasonable to rationalize that the <br />City does already have the roadway easements within the proposed <br />development were the proposed utilities will be installed. The <br />limits of the these areas are defined and can not be altered <br />without City action. The permanent easements referred to were <br />defined and accepted with the Center Hills, Second Addition <br />development due to the need to install telephone lines. <br /> <br />Motion by Burgstahler, second by Wilharber to order Plans and <br />Specifications for the proposed Center Hills, Third Addition, <br />contingent upon: <br />the developer submitting an appropriate escrow amount <br />to cover the cost of said Plans and Specifications; <br />the developer willingness to escrow appropriate funds <br />and absorb all costs if the City and the Developer can <br />not reach an agreement regarding the final plat or the <br />development agreement; <br />receipt of appropriate petitions for improvement of the <br />project, <br />motion carried unanimously. <br /> <br />Council member Wilharber noted that Gerald Rehbein, Developer, <br />does sometimes do projects out of order, but he appears to be the <br />developer with the least amount problems. <br /> <br />Center Hills, Second Addition, Reduction of Letter of Credit <br />It was noted that the site grading, seeding and erosion control <br />in the amount of $10,000.00 and frontage and barricade in the <br />amount of $400.00 are now complete on the Center Hills, Second <br />Addition project. <br /> <br />Motion by Burgstahler, second by Wilharber to reduce the Letter <br />of Credit for the Center Hills, Second Addition from $64,935.00 <br />to $49,335.00, motion carried unanimously. <br /> <br />Adult Entertainment Ordinance <br />Motion by Burgstahler, second by Wilharber to direct City Staff <br />to prepare an ordinance addressing Adult Entertainment based upon <br />the model of the League of Minnesota Cities and checking <br />conformance with neighboring cities, motion carried unanimously. <br />
