<br />PUBLIC HEARING MINUTES <br />DECEMBER 9, 1992 <br />PAGE TWO <br /> <br />West Robin Lane who indicated that the request for this larger <br />garage was due to the fact that he owns three cars and due to a <br />ticket on one of his cars for expired tabs. He now needs to <br />store all three cars inside of his garage. Additionally, since <br />the City requires him to remove his 10 x 10 shed he has other <br />miscellaneous pieces of equipment which must be stored in this <br />garage. Mr. Burn stated that a 24 x 24 garage would not hold all <br />of his equipment. <br /> <br />This variance request is before the City Council without <br />recommendation from the Planning and Zoning Commission due to an <br />error by the Quad Community Press in the public notice which <br />listed in the legal that the garage was requested to be built <br />with the dimension of 24 x 20 feet rather than 24 x 30 feet. <br /> <br />Mr. Burn indicated that there are two other garages in the <br />neighborhood which exceed the ordinance requirement for the <br />number of square feet as compared to the size of the back yard. <br /> <br />Mayor Buckbee expressed his concern for the construction of the <br />other two garages that are larger than code. However, based on <br />an opinion from the City Attorney these other two garages do not <br />set a precedent in the neighborhood. Mayor Buckbee further <br />stated that he would not be in favor of any variance of this type <br />unless it met the four provisions of Ordinance #4 as listed <br />above, some regulation of the size of garages is need. <br /> <br />Mr. Burn stated that if the garage would be attached to the house <br />it could be built to this size. <br /> <br />Clerk/Administrator Siebenaler stated it was the opinion of the <br />City Attorney that the City Council should direct staff to send a <br />letter to the owners of the other two garages and indicate that <br />their garages are not in conformance with City ordinance and, if <br />they were more than 50% destroyed they would not be allowed to <br />rebuild the garages at the original size. The neighbors could <br />request a variance for their garages at this time and would, upon <br />City Council approval, be in conformance. <br /> <br />Upon further discussion Council member Dario moved to the close <br />the public Hearing. The motion was seconded by Council member <br />Pelton and was unanimously approved.
