<br />MINUTES OF THE PUBLIC HEARING OF THE <br />CITY COUNCIL OF THE CITY OF CENTERVILLE, MINNESOTA <br />HELD ON WEDNESDAY, DECEMBER 9, 1992 <br />AT 7:00 P.M. IN THE COUNCIL CHAMBERS <br /> <br />Pursuant to due call and notice thereof the City Council of the <br />City of Centerville held a public hearing on Wednesday, December <br />9, 1992 at the City Hall. Mayor Buckbee called the meeting to <br />order at 7:00 p.m. Present: Dario, Pelton, Wilharber. Absent: <br />Burgstahler. <br /> <br />Mayor Buckbee stated that the reason for the public hearing was <br />to discuss and act upon a variance request from Mr. Curtis L. <br />Burn of 7169 West Robin Lane. Mr. Burn has requested a variance <br />to exceed the amount of yard occupied for an accessory building <br />by 3.69% (210 square feet) over the allowed area covered in a <br />rear yard area by an accessory building. This proposed garage <br />would be 37% larger than an allowable garage. <br /> <br />Mayor Buckbee explained that Centerville.s Ordinance _4, Section <br />65.03 STANDARDS states that the Council shall order the issuance <br />of a variance only if it conforms to the following four <br />standards: <br />Ordinance _4, Section 65.03-1 Special conditions and <br />circumstances exist which are peculiar to the <br />land, structure, or building involved and do <br />not result from the actions of the <br />petitioner; <br />Section 65.03-2 Literal interpretation of <br />the provisions of this ordinance would <br />deprive the petitioner of rights commonly <br />enjoyed by other properties in the same <br />district under the terms of this ordinance; <br />Section 65.03-3 Granting the variance <br />requested will not confer on the applicant <br />any special privilege that is denied by this <br />ordinance to other lands, structures, or <br />buildings in the same district; <br />Section 65.03-4 - The proposed variance will <br />not impair an adequate supply of light and <br />air to adjacent property, or unreasonably <br />diminish or impair established property <br />values within the surrounding area, or in any <br />other respect impair the public health, <br />safety, or welfare of the residents of the <br />city. <br /> <br />.. <br /> <br />Mayor Buckbee then opened the public hearing for public input. <br /> <br />Appearing before the City Council was Mr. Curtis Burn of 7169 <br />
