<br />CITY COUNCIL MEETING MINUTES <br />NOVEMBER 23, 1992 <br />PAGE FOUR <br /> <br />A copy of the Equipment Lease Agreement is on file with the <br />Clerk/Administrator. <br /> <br />Gopher One Call <br />Ray Siebenaler (future Clerk/Administrator) appeared before the <br />City Council to present a Gopher One Call Agreement. <br /> <br />Mr. Siebenaler advised that the Gopher One Call is a good service <br />as it protects the residents, contractors and the City. <br /> <br />The City reviews each dig request. If the City responds by <br />advising "No Locate Requested (NLR)", there is no charge. If the <br />City does not respond within 48 hours there is a $2.50 fee. <br /> <br />Mr. Siebenaler noted that the City is mandated by the State of <br />Minnesota to become part of the service. He noted that <br />differences could be that instead of supplying the contractors <br />with the "as builts", the City will now go out and mark locations <br />(if appropriate). This would need to be performed by someone who <br />can measure and locate accurately. <br /> <br />Motion by Pelton, second <br />authorizing Mayor Buckbee to <br />One Call on behalf of the <br />unanimously. <br /> <br />by Wilharber to adopt a resolution <br />enter into and agreement for Gopher <br />City of Centerville, motion carried <br /> <br />Fete de Lacs - Carnival Liti~ation <br />Council member Wilharber noted a letter dated November 3, 1992 <br />from the attorney of Skip Reinke (Minnesota Magic Midway). The <br />letter states that the carnival was unable to provide service at <br />the Festival due to a murder in the family. <br /> <br />Wilharber noted that the carnival was to provide advance tickets <br />to the City months before the Festival. Wilharber noted that <br />unless the murder of the family member was known in advance of <br />its occurrence, nonperformance due to this reasoning is not <br />logical. <br /> <br />A copy of the above <br />Clerk/Administrator available <br />of pending litigation. <br /> <br />letter is <br />for public <br /> <br />on file with the <br />review upon resolution <br /> <br />Park Land Purchase Investi~ation <br />Council member Wilharber noted that he has spoken with Shirley <br />Drewlo regarding the sale of the LaMotte Estate land which abuts <br />Central Park. He noted the Ms. Drewlo appeared to be interested <br />in selling, but that she also had other parties looking at the <br />land. <br />
