<br />Pursuant to due call and notice thereof, the Centerville City <br />Council held a special meeting on Tuesday, October 27, 1992 at <br />City Hall. The purpose of the meeting was to hold a joint <br />working session with the Park and Recreation Commission and the <br />Planning and Zoning Commission to discuss park facilities and <br />location in the Northeast Quadrant of the City of Centerville. <br />Mayor Buckbee called the meeting to order at 7:10 p.m. Present: <br />Wilharber, Pelton, Burgstahler, Dario. <br /> <br />Other present were: <br />Park and Recreation Committee members Dixon, Reisdorfer, <br />Navin, Drilling and Larson; <br />Planning and Zoning Commission Chairperson Tourville; <br />City Attorney, Greg Hellings. <br /> <br />Council member Burgstahler introduced the meeting noting that the <br />City Council can not feasibly discuss the proposed plat for the <br />Acorn Creek Development until it is known if there will be park <br />land, location and how large would be. <br /> <br />He noted that park land can be acquired from a willing seller or <br />through eminent domain proceedings. He further noted that while <br />he was not recommending eminent domain, it was an option and the <br />City should be aware of the proceedings. <br /> <br />Greg Hellings, City Attorney explained that eminent domain can be <br />used if the City is acquiring the land for a public purpose. He <br />noted that a park is a public purpose. <br /> <br />Mr. Hellings explained the eminent domain process. He noted that <br />the disadvantage would be the cost to the City. He advised that <br />the "City would have to pay for the Commissioners fees, the City's <br />appraisal, the property owner appraisal (up to $500), attorney <br />fees and staff time. Commissioners receive $200 per day and the <br />Commission Chairperson receives $400 per day. Commissions <br />usually take four to seven days for preparation time. <br /> <br />It was Mr. Hellings recommendation that if the difference in <br />price on a property is between $5,000 and $10,000, a settlement <br />would be appropriate versus eminent domain proceedings. <br /> <br />Mr. Hellings further suggested that the City obtain an appraisal <br />prior to beginning any possible eminent domain proceedings to see <br />if the asking price of the seller is within the ball park. <br /> <br />Ken Vanderbeek, 6892 Centerville Road was present at the meeting. <br />Mr. Vanderbeek advised that he has worked with Gerald Rehbein on <br />the proposed Acorn Creek project. He noted that it has been <br />suggested that Central Park be expanded versus placing a large <br />park in the Northeast Quadrant of the City. <br /> <br />Park and Recreation Committee member Reisdorfer commented that if <br />Central Park could be enlarged with a Centerville Road access, <br />
