<br />Pursuant to due call and notice thereof, the City Council of <br />Centerville held their regular meeting on Wednesday, May 9, <br />1984 in City Hall. Mayor L'Allier called the meeting to order <br />at 7:00 PM. Present were: Ayers, Baumann, Wilharber and <br />Zimny. Motion by Baumann, second by Wilharber to approve <br />minutes of April 25, 1984 meeting, motion carried. <br /> <br />PETITIONS AND COMPLAINTS: none. <br /> <br />Old Business: Lifting road restrictions - as of May 10th, 1984, <br />all road restrictions will be lifted on Centerville City streets. <br /> <br />MCI/Airsignals Drewlo/Tuckner appraisals on property proposed <br />for MCI radio tower: Messrs. Roberge, MCI; appraiser <br />Robert LaFond, Mrs. Drewlo and Mrs. Tuckner; appraiser Eldon <br />Robby and several members of audience voiced their views, <br />comments, etc., on the proposed tower. Councilman Wilharber <br />excused himself from proceedings to state that his mother, <br />Mrs. Walter Wilharber, 681) Centerville Road opposes the <br />tower site. Attorney Hawkins advised council of his legal ~p <br />opinion concerning council's decision on matter. Motion by <br />Zimny, second by Baumann for City of Centerville to grant a <br />Special Use Permit to allow the construction of a 295' radio <br />tower by MCr/Air~gnals on the Walter Prachar property as <br />outlined on blueprint on file with the City Clerk with the <br />following stipulations: <br />(1) subject to site being surrounded by a 8' chain link <br />fence and landscaped by MeI as agreed to previously and to <br />the satisfaction of City, property owner and MCI; <br />(2) subject to hold harmless clause as to TV reception in <br />area being included as a condition of permit to assure <br />residents' TV reception will not be affected by tower or <br />MCr will correct it; <br />()) City will enOOY further benefit of tower relative to <br />the wrection of civil defense siren, police or fire radio <br />communication equipment and other reasonable uses to be <br />negogiated between City and MCI; <br />(4) subject to annual tax assessment based on valuation <br />of the property site, legal description attached, including <br />all improvements; <br />(5) subject to formal review wi~hin six months from this <br />date; <br />(6) subject to MCI acquiring all other necessary permits <br />and licenses; <br />(7) allowing city attorney to prepare formal resolution <br />in legal form; <br />(8) subject to the fact MCI would not put any additional <br />receiving or transmitting discs on the tower without <br />council approval, roll call taken, Zimny, aye; Baumann, aye; <br />Ayers, nay; Wilharber, nay; L'Allier, nay; motion denied. <br />
