<br />Pursuant to due call and notice thereof, the City of Centerville <br />City Council held the first 1989 bud~et meeting Wednesday, August <br />17, 1988 at the Centerville Elementary School. Mayor L'Allier <br />called the meeting to order at 7:05 p.m. Present: Fritchie, <br />Wilharber, Neumann, Burgstahler. <br /> <br />Clerk noted that the City Attorney requested that two other items <br />also be discussed at this meeting, which required immediate <br />attention. Mayor L'Allier noted that when ever possible these <br />items should be posted on the notice of the meeting. Clerk <br />explained that the items only came up that day. <br /> <br />Motion by Burgstahler, second by Wilharber that the permanent <br />drainage easement required by Rice Creek Watershed to facilitate <br />the Centerville Plaza, be accepted by the City; contingent upon <br />the developer agreeing to an addition in the Special Use Permit, <br />that the developer and/or all successors will be responsible for <br />the maintenance of the easement, motion carried unanimously. <br /> <br />Clerk advised Council of an resident on Mill Road whose well and <br />pump became inoperable recently. The municipal water main runs <br />directly in front of the property. Clerk advised Council that <br />per Ordinance #45, Section 18, the resident is required to hook <br />up to the municipal water system. Clerk had discussed this with <br />the City Engineer, City Attorney, and City Building Inspector. <br />Clerk discussed the matter with the resident on August 15 and <br />August 16. On both occasions Clerk advised resident not to drill <br />his own well. <br /> <br />City Engineer advised that the resident could be hooked up to the <br />system within 24 hours. The water available to the resident <br />would not be from the City well/water tower, but would <br />temporarily come from another source, which would be run through <br />the municipal system until the City pump was operational <br />(approximately 7 days). <br /> <br />The City Attorney discussed the matter with the resident on <br />August 16. City Clerk and City Attorney (separately) advised <br />resident of the requirement to hook up to municipal water and the <br />of the penalties if he did not abide by the ordinance (citation <br />for a misdemeanor and $2,500 assessment to the property). <br /> <br />It was reported to the City that the homeowner did have a well <br />drilled on the property. Clerk directed Building Inspector to <br />investigate this report. Building Inspector did verify that a <br />new well did exist. <br /> <br />Clerk requested direction from the Council. <br /> <br />Motion by Neumann, second by Fritchie to follow City Ordinance <br />and under the direction of the City Attorney enforcement of <br />penalties and assessments is to be implemented, to include a <br />citation to the resident at 7221 Mill Road to be given by the <br />Building Inspector and a Lino Lakes Police Officer, motion <br />
