Motion <br />by Ayers, second by Robischon to authorize the Mayor and <br />the Clerk to enter into a contract with Lake Sanitation with <br />the following modificationsl <br />- Increase personal injury insurance from <br />$.500,000 to $600,000, <br />- Terms and conditions remain the same, <br />Charges remain the same unless the State <br />imposes a tax, <br /> <br />motion carried. <br /> <br />Appearance of Mike Kaphing - 7277 Clearwater Drive. <br />Discussion of alternatives to drain his discharge pipe. <br />Harvey will work with him to solve his drainage problem. <br /> <br />Motion by Ayers, second by Robischon to adopt Resolution IIII <br />Bylaws Governing the City of Centerville's Park and Recreation <br />Committee with the following amendment I Article III, D - <br />When a vacancy occurs, a new member will be appointed by the <br />Centerville City Council as recommended by the Park and <br />Recreation Committee to serve the unexpired term, motion <br />carried. <br /> <br />Discussion on the rezoning at 6805 - 20th Avenue South. <br />Referencing an analysis by Peter Buesseler, member of the <br />Planning and Zoning Commission, there is some question that <br />the procedure used in the initial rezoning of the property <br />from Commercial to Industrial was in accordance with State <br />statutes and local ordinances. <br /> <br />Motion by Wilharber, second by Robischon to forward Peter <br />Buesseler's analysis of the rezoning at 680.5 - 20th Avenue <br />South along with copies of the minutes from Council and <br />Planning and Zoning meetings to the City Attorney for a <br />written legal opinion, motion carried. <br /> <br />Harvey will contact Jim's Remodeling to clarify the width and <br />depth of the ditch at 7228 Mill Road, and also to clarify <br />whether or not sod was included in his $49.5.00 estimate. <br /> <br />Harvey will contact Randy Lauderbaugh to see if he can do <br />some grading on Peltier Lake Drive. <br /> <br />Discussion on the vacation of street at Mill Road and Main <br />Street. In light of Mr. Almendinger's easement, the Planning <br />and Zoning Committee is still recommending the vacation of <br />8th Street. <br /> <br />Motion by Ayers, second by Wilharber to have our City Attorney <br />give a written legal opinion to advise the City Council on <br />in this matter by the next council meeting, motion carr~ed. <br /> <br />\~ <br /> <br />I <br />-~.~ <br />
