<br />Page Three - City Council <br />Meeting Minutes <br />June 11, 1986 <br /> <br />- Impairing Values or Welfare of Residents: <br />- the new site of lots 10 & 11 would conform to the <br />ordinance <br />- the west one third of lots 7, 8 & 9 could have <br />restrictions on home size to conform with residences <br />to the east. <br /> <br />Motion by Zimny, second by Fritchie to grant variance request <br />to separate the west one third of lots 7, 8 & 9 in Block 2 <br />from lots 10 & 11 in Block 2, Centerville, motion carried <br />unanimously. <br /> <br />Discussion on Merabella request for variance from setback <br />requirements. The Planning and Zoning Commission recommended <br />the City Council allow a variance to Ordinance #4, Section <br />34.01-2 requesting the setback of the west property line <br />(off Progress Road) of the west one third of lots 7, 8 & <br />9, Block 2 in Centerville be no closer than 16 feet to that <br />property line. The required standards for variances seem to <br />be met: <br />- Existing Special Circumstances - This is a 50' lot <br />of record next to several other 50' lots with homes <br />on them. There is a sewer stub installed on this <br />property. This parcel is separated from adjacent property <br />by sewer easement. <br />- Literal Interpretation of Provisions - There are many <br />50' x 150' lots built upon in Centerville. Other <br />property owners have been granted variances in similar <br />circumstances. Strict interpretation would leave this <br />site unsaleable. There is presently a home on Progress <br />road with about an eight foot setback. <br />- Special Privileges - Others have the right to request <br />a similar variance. In the past other property owners <br />have received a similar variance. <br />- Impair Values or Welfare of Residents - Setback would <br />allow good vision to insure safety on both Main Street <br />and Progress Road. A new home would enhance the <br />value of the other homes in the area. <br />Motion by Zimny, second by Robischon to grant the variance <br />to Ordinance #4, Section 34.01-2 requesting the setback of the <br />west property line (off Progress Road) of the west one third <br />of lots 7, 8 & 9, Block 2 in Centeville be no closer than <br />16 feet to that property line, motion carried unanimously. <br /> <br />Discussion on Kuntz request for variance from setback <br />requirements to construct a one or two family dwelling. <br /> <br />The Planning and Zoning Commission recommended the City Council <br />deny the variance request for a two family dwelling due to <br />the size of the lot. The request did not meet the required <br />standards for variances. <br />- The construction of a two family dwelling is a result <br />of the petitioners actions, not special conditions <br />- Literal interpretation would not deprive the petitioner <br />of rights enjoyed by others <br />- This would grant a special privilege denied to others <br />
