<br />Council Member Nelson indicated the City would sue the Lions. City Attorney Hoeft <br />indicated that was fine with him because he is the only one that comes out ahead on that <br />type of situation. He then commented that the City would not win any popularity <br />contests by suing the Lions. <br /> <br />Motion bv Council Member Nelson. seconded bv Council Member Capra to enter <br />into the aereement as discussed with the Lions. All in favor. Motion carried <br />unanimouslv. <br /> <br />4. Surface Water Management Plan (Update) <br /> <br />Ms. Moore-Sykes indicated there was nothing new to report as Staff is still working on <br />the spreadsheet that will be part of the stormwater management plan. <br /> <br />Council Member Broussard Vickers indicated that the Planning and Zoning Commission <br />is interested in the storm water management plan as it relates to the CI zoning areas. <br /> <br />Council Member Nelson expressed concern with a statement in the January 8, 2002 <br />Planning Commission minutes that indicates that a variance would be granted by inaction <br />if a waiver was not signed and Council did not vote on it at the next meeting which would <br />have been the following day. <br /> <br />Council Member Broussard Vickers asked if the resident had signed a waiver. Ms. <br />Moore-Sykes indicated she was not sure but would look into it. <br /> <br />Council Member Broussard Vickers explained that, procedurally, this was an issue but <br />noted there is no issue with the variance being granted because the Planning and Zoning <br />Commission anticipated making changes to the Cl zoning that would allow for the deck <br />to be built and Rice Creek Watershed District had approved the plans pending approval <br />by the City. <br /> <br />Council Member Nelson indicated she is upset about the situation and does not like the <br />fact that a variance gets to Council when it is too late and is approved automatically. <br /> <br />Council Member Broussard Vickers indicated this variance was the first one that she can <br />recall that was granted by inaction, if the waiver was not signed. <br /> <br />Council Member Nelson indicated it could set precedent as a way to push things through <br />and obtain approval. <br /> <br />Council Member Broussard Vickers indicated that the whole issue stemmed from the fact <br />that the Cl district needs to be rezoned and the Planning and Zoning Commission needed <br />further input from the City Attorney before doing so. She then indicated that Planning <br />and Zoning did not want to make a decision on the variance until it determined what to <br />do about the zoning of the Cl district.
