<br />City of Centerville Ord #24 <br />Effective: 10/27/99 <br /> <br />keeper of the animal and any person found to have violated the provisions of this Section shall be <br />guihy of a misdemeanor. <br /> <br />Subd. 8 Other. Any "nimal~ kept contrary to this Section are subject to impoundment as <br />provided in this Ordinance. <br /> <br />24.09 Seizure of Animals. Any police officer or animal control officer may enter <br />upon private property and seize any animal provided that following exist: <br /> <br />(1) There is an identified complainant other than the police officer or animal <br />control officer I'l"king a contemporaneous complaint about the animal; <br /> <br />(2) The officer reasonably believes that the animal meets either the habitual <br />barking/crying criteria; criteria for inhumane treatment; or the criteria for an at <br />large animal as set forth herein. <br /> <br />(3) The officer can demonstrate that there has been at least one previous <br />complaint of habitual barking; inhumane treatment; or that the animal was at large <br />on a prior date; <br /> <br />(4) The officer has made a reasonable attempt to contact the owner of the <br />property and those attempts have either fuiled or have been ignored; <br /> <br />(5) The seizure will not involve the rorced entry into a private residence. Use of a <br />pass key obtained from a property m"nager, landlord, innkeeper, or other <br />authorized person to have such key shall not be considered unauthorized entry; <br />and; <br /> <br />(6) Written notice of the seizure is left in a conspicuous place if personal contact <br />with the owner of the animal is not possible. <br /> <br />24.10 Humane Treatment of Animals. The owner of any animal within the City shall provide <br />such "nim,,1 with sufficient wholesome rood and water on a daily basis, proper and sufficient <br />sheher from the weather, and veterinary care when needed to prevent suffering of any sick or <br />injured animal. No person shall beat, torment, tease, or otherwise abuse an "nimal, or pennit an <br />"nimal fight. Any person not treating their pet in such humane manner will be subject to the <br />penalties provided in this Ordinance. <br /> <br />24.11 Domestic Animal Shelters. A person in charge or control of any domestic animal which <br />is kept outdoors or in an unheated enclosure shall provide the domestic "nim,,] with shelter and <br />bedding as prescribed in this Section as a minimum <br /> <br />Page 10 of 16 <br />
