If the animal is found to be diseased in such a maoner so as to be a <br />danger to the health and safety of the City, the officer shall cause such anim"l to be <br />euthanized and shall properly dispose of the remains. Reasonable effurts will be made to notify <br />the owner or keeper of the animal prior to the euthanasia. The owner will be liable to cover the <br />cost of maintaining and disposing of the Hnima I, plus the costs of any veterinarian eJ<llminHtions. <br /> <br />Subd.3 Release. If the animal, upon examination, is not fuund to be diseased within the <br />meaning of this Section, the animal shall be released to the owner or keeper free of charge. <br /> <br />24.16 Desigltlltion as Dangerous or Potentially Dangerous Animal. The anima] control officer <br />shall designate any animal as a dangerous or potentially dangerous animal upon receiving such <br />evidence that meets the definition as stated in this Ordinance. When an animal is declared <br />dangerous or potentially dangerous the animHl control officer shall cause one (1) owner of the <br />potentially dangerous or dangerous animHl to be notified in writing that such animal is potentially <br />dangerous or dangerous. <br /> <br />Subd. 1 Authority to Order Destruction. The animal control officer, upon finding that an <br />animal is dangerous or potentially dangerous hereunder, is authorized to order, as part of the <br />disposition of the case, that the llnimHl be destroyed based on written order from City Council. <br /> <br />Subll. 2 Procedure. The animal control officer, after having determined that an animal is <br />dangerous or potentially dangerous, may proceed in the following manner: <br /> <br />(l) The animal control officer shall cause one (l) owner of the animal to be <br />notified in writing or in person that the animal is dangerous or potentially <br />dangerous and may order the animal seized or make such orders as deemed proper. <br /> <br />(2) If the owner ofan animHl elects to aPPea4 the appeal shall be referred to the <br />City Council for a hearing. The City Clerk shall notify the owner of such animal by <br />certified mail, return receipt requested, of the time of the hearing at least fuurteen <br />(14) days prior to the hearing. The notice shall state that the owner may be <br />represented by legal counsel during such hearing and may provide oral and written <br />testimony. The Council shall maintain an electronic record of the hearing. <br /> <br />(3) !fan owner requests a hearing for detennination as to the dangerous <br />nature of the animal, the hearing shall be held before the City Council, <br />which shall set a date for hearing not more than three (3) weeks after <br />demand for the hearing. The records of the animal control or City Clerks <br />office shall be admissible fur consideration by the animal control officer <br />without further foundation. After considering all evidence pertaining to <br />the temperament of the anim"l, the City Council shall make an order as it <br />deems proper.
