If the affected <br />person(s) has not complied with the requirements of this section within the one year <br />period established herein, where one or more of the affected person(s) is an elected or <br />appointed officer, and the remaining person(s) is an employee of the City, the City <br />Administrator shall recommend termination of the employee(s); and where the affected <br />persons are employees, the City Administrator shall recommend tenmination the <br />affected person(s) with the shortest length of employment with the City. This provision <br />applies to all positions of the City. <br /> <br />19.6 Nothing herein shall be interpreted as requiring an employee at the time of <br />an election to be discharged because a relative described herein has been elected an <br />officer of the City. <br /> <br />SECTION 20. OFFENSIVE BEHAVIOR <br /> <br />It is the City's policy to maintain a working environment free from offensive or <br />degrading remarks or conduct. Such behavior includes inappropriate remarks about the <br />employee's race, color, creed, religion, national origin, sex, marital status, disability, <br />sexual orientation, age and status with regard to public assistance. Offensive behavior <br />prohibited by this policy also includes requests to engage in illegal, immoral or unethical <br />conduct. <br /> <br />One specific kind of illegal behavior is sexual harassment. Sexual harassment, <br />which can consist of a wide range of unwanted sexually directed behavior, is defined as: <br /> <br />1. Unwelcomed and unwanted sexual advances; <br />2. Requests or demands for sexual favors; <br />3. Verbal abuse or kidding that is sexually-oriented and considered <br />unacceptable by another individual; <br />4. Any type of sexually-oriented conduct that would interfere with another's <br />work performance; <br />5. Creating a work environment that is intimidating, hostile, or offensive <br />because of unwelcomed or unwanted sexually-oriented conversations, suggestions, <br />requests, demands, physical contacts or attentions. <br /> <br />Any person who feels he or she is being subjected to offensive behavior of any <br />kind should feel free to object to the behavior and should also report the behavior to <br />either his/her Department Head or the City Administrator. <br /> <br />All allegations of offensive behavior will be investigated promptly, fairly and <br />completely. The facts shall determine the response to each complaint. Each situation will <br />be handled discreetly. In the event that the offensive behavior reoccurs, it should <br />immediately be reported to either of the persons named above. <br /> <br />Employees should understand that this policy applies to each and every employee <br />of the City, including management and all full-time, part-time, and temporary employees. <br />No retaliation or intimidation directed towards anyone who makes a complaint will be <br />tolerated. <br />
