<br />promote the stability and economic security <br />of families, and to promote national <br />interests in preserving family integrity. It <br />is intended to benefit employees as well as <br />employers by providing up to twelve (12) <br />weeks of unpaid, job protected leave for the <br />birth of a child, adoption, foster care and <br />certain family and medical reasons. <br /> <br />b. Eligible Employees. Eligible employees are <br />those who have: <br />1. Been employed by the City of Shakopee for <br />at least one year; and <br />2. Worked a minimum of 1250 hours within the <br />previous twelve (12) month period. <br /> <br />c. Circumstances Covered by Family Leave. FMLA <br />leave will be granted to an eligible employee <br />for any of the following reasons: <br />1. To care for their child (birth, or <br />placement for adoption or foster care <br />with the employee); <br />2. To care for their spouse, son or <br />daughter, or parent, who has a serious <br />health condition; or <br />3. For a serious health condition that makes <br />an employee unable to perform their job <br />duties. <br /> <br />d. Serious Health Condition. A serious condition <br />is defined as any illness, injury, <br />impairment, or physical or mental condition <br />that requires: <br />1. Inpatient care in a hospital, hospice or <br />residential medical care facility; or <br />2. Prenatal care; or <br />3. Any period of incapacity requiring <br />absence from work, school or other <br />regular activities, of more than three <br />calendar days, that also involves <br />continuing treatment by, or under the <br />supervision of, a health care provider; <br />or <br />4. Continuing treatment by, or under the <br />supervision of, a health care provider <br />for a chronic or long-term condition that <br />is incurable or so serious that, if not <br />treated would likely result in a period <br />of incapacity of more than three calendar <br />days. <br /> <br />V-5 <br />
