<br />Upon the request of the City Administrator or desiQnee, the police department <br />shall provide certain criminal history data contained in the Minnesota Criminal <br />Justice Information System. The data to be provided must only be about finalists <br />for City positions of employment. The City Administrator or desiQnee must obtain <br />the consent of the finalists before reQuestinq the data, but an applicant's failure to <br />provide consent mav disqualify the applicant from the prospective position. <br /> <br />5 EMPLOYMENT STATUS CHANGES <br /> <br />5-1 Reclassification <br />A recommendation for an individual employee to receive a reclassification will be <br />made on the basis of the job's content, resulting from significant changes in the <br />kind, difficulty, and/or responsibility of the work performed in the position. A <br />reclassification may warrant an increase or decrease in salary range. The City <br />Council must approve all reclassification recommendations made by department <br />heads. <br /> <br />5-2 Promotion <br />Vacancies shall be filled by promotion of present employees who meet the <br />requirements established for the classification, when it is in the best interest of <br />the City. <br /> <br />5-3 Demotion <br />An employee Employees may be demoted if found unsuited for the present <br />position but may be expected to perform satisfactorily in 3 lesser position E <br />position of havinq a lower pay ranqe. rank or Qrade, and/or lesser responsibility <br />than previously held. Employees An employee may also be demoted if their <br />position has been abolished or reclassified to a lowor clClss and tHey he/she <br />cannot be transferred to a position of equal pay for which they are qualified and <br />suited. <br /> <br />5-4 Reduction of Workforce <br />If it is necessary to reduce personnel, temporary employees and those serving a <br />probationary period trClining period in affected job classes will be separated <br />before regular employees. Within each of these groups, the selection of <br />employees to be retained shall be based on merit and ability as determined by <br />the department head, subject to Council Approval. <br /> <br />The City may layoff any employee whenever such action is made necessary as <br />provided in the annual budQet by reason of shortaqe or work or funds, the <br />abolition of a position or because of chances in orQanization. Two weeks <br />advance written notice of the lay-off shall be Qive. An employee may be <br />transferred to another position if such employee is qualified and a position is <br />available.
