<br />financial or other private interest of the elected official or employee or <br />anyone else authorized to act on the behalf of the City. <br /> <br />No elected official or City employee who has custody of or access to any <br />personnel files or other information which may be considered confidential <br />by Minnesota law shall use or release such information without proper <br />authority. <br /> <br />23.7 Political Activities <br />Political activities which are not in violation of state and federal laws are <br />generally permitted. <br />The following political activities that are prohibited for City employees and <br />elected officials: <br /> <br />1. elected official or City employee may use any <br />official authority or influence for the purpose of <br />affecting the result of an election nor may funds be <br />solicited or contributions received from other <br />employees for political purposes. <br /> <br />2. No campaign materials, pamphlets of buttons may <br />be displayed on City vehicles, City property or by <br />an individual on the work site. <br /> <br />23.8 Advisory Opinions <br />Where any elected official or City employee has a doubt as to the <br />applicability of any provision of this ordinance to a particular situation, or <br />as to the definition of terms used herein, that person may apply to the City <br />Attorney for any advisory opinion. <br /> <br />In any matter where an elected official or City employee has sought an <br />advisory opinion from the City Attorney and the elected official or City <br />employee is subsequently prosecuted for a v8iolation of this ordinance for <br />an action which conformed to the City Attorney's opinion, the case shall be <br />referred to the Anoka County Attorney's office. <br /> <br />23.9 Penalties <br />Any elected official or City employee who is convicted in a court of law of <br />willfully violating provisions of this ordinance shall be guilty of a <br />misdemeanor, punishable accordinq to the Minnesota Statutes ef-a <br />monetary fine not to exceed $700 or incarceration in jail for a period f-or a <br />period not to mmeed 90 days and be subject to disciplinary proceedings <br />before the City Council which may result in termination. dismissal of that <br />person from his or her position. <br />
