<br />period of time for improvement. Serious infractions may require skipping either the oral <br />or written warning, or both. <br /> <br />E. Suspensions of five days or more, or any second suspension for the same individual, <br />the Council shall review the reasons for the suspension and upon review wjlJ make a <br />decision as to the future status of the employee and his/her employment with the City. <br /> <br />F. Discharge is subject to state law on veteran's preference and Minnesota Statutes <br />9181.931 - 181.935, Council may dismiss an employee substandard work performance, <br />behavior not in keeping with City standards, or if in their judgment the employee is <br />unsuited to employment with the City. <br /> <br />17.3 Other Disciplinary Action <br /> <br />At times it may be appropriate to consider other disciplinary actions. At the <br />Administrator's discretion, with Council approval, the following other actions may be <br />taken: <br /> <br />1. Involuntary demotion. This action may be used if, as determined by the <br />Administrator, an employee is unable or unwilling to perform <br />satisfactorily in their position. <br />2. Involuntary transfer. This action includes transfers to similar or <br />comparable positions under a difference supervisor. <br /> <br />17.4 Hearings <br /> <br />Non-probationary employees shall have a right to a hearing in cases of suspensions of <br />five (5) or more days, dismissals, or demotions, upon written request of the employee <br />within five (5) working days of notification of the action taken. The hearing shall be held <br />within ten (10) working days of the date ofthe request, unless the employee and City <br />mutually agree to another date. Removal of veterans may be made only for incompetence <br />or misconduct shown after a hearing with due notice. <br /> <br />Article 18 <br /> <br />Resi!!:nations <br /> <br />A. Any employee wishing to leave municipal service in good standing shall submit a <br />written resignation to the department head at least fourteen (14) calendar days before their <br />last working day. The resignation must state the effective date. The City Administrator <br />may waive the notice requirement ifit is determined to be in the best interest of the City. <br /> <br />B. Unauthorized absence from work for a period of three working days wjlJ be <br />considered as a resignation from employment (not in good standing). The City <br />Administrator may waive this rule, if in his or her judgment, extenuating circumstances <br />warrant such waiver. <br />
