<br />'> <br /> <br />Resolution No. 00-43 <br />Page 2 <br /> <br />SECTION 1. PURPOSE AND APPLICATION <br /> <br />1.1 The purpose of the policy is to establish and maintain a reasonable system <br />for administration of all personnel matters in the City of Cottage Grove. These procedures <br />shall be administered by the City Administrator who may delegate the responsibility of <br />assisting in the administration of these personnel policies and procedures. <br /> <br />1.2 The City reserves the right to operate and manage its affairs in all respects <br />in accordance with existing and future laws and regulations. These rights shall specifically <br />include, but not be limited to, the right to adopt, amend, repeal, interpret or terminate the <br />personnel policy and work rules without prior notice. Any prerogative or authority which <br />the City has not specifically abridged, delegated or modified by this policy is retained by <br />the City. The City further reserves the right to make reasonable variations from this policy <br />where it is determined that a strict and literal application of the policy would cause an <br />undue hardship on the City, its employees, or an individual employee. <br /> <br />1.3 When there is conflict with the personnel policy, the following order of <br />precedence shall apply: <br />A. All applicable state and federal laws. <br />B. Labor agreements. <br />C. Personnel policy. <br />D. Departmental rules. <br /> <br />1.4 The provisions of this ordinance shall apply to all offices, positions and <br />employment of the City, except: <br />A. Elected officials, appointed commission members, or volunteers. <br />B. Persons engaged under contract to supply expert, professional, <br />technical, or any other service. <br />C. Temporary employees who are hired to meet immediate <br />requirements of an emergency condition. <br /> <br />1.5 Captions. This policy shall be subject to all applicable State and federal <br />laws, as well as City ordinances. <br /> <br />SECTION 2. DEFINITIONS <br /> <br />The following words and terms shall have the meaning as defined herein, unless the <br />context indicates otherwise. <br /> <br />A. Appointing Authority - The City Councilor City officer to whom the Council has <br />delegated authority to appoint personnel. <br /> <br />B. Benefits - Privileges or non-monetary compensation granted to employees which <br />are included in the total compensation to employees. <br /> <br />C. Compensatory Time - For exempt employees, the same amount of time off work <br />as the employee has overtime hours worked. For non-exempt employees, time off <br />work at one-and-one-half times the number of overtime hours worked. <br />
