<br />City of Centerville <br />August 28, 2002 <br />Council Meeting Minutes <br /> <br />IV. PUBLIC HEARING(S) <br /> <br />1. Provosed Ordinance #13 - Possession. Sale and Consumption of Intoxicating <br />Liquor. Wine and 3.2 Percent Malt Liquor Within the City ofCenterville. <br /> <br />Mayor Swedberg opened the public hearing at 6:40 p.m. <br /> <br />Donna King of 1724 Sorrel Street addressed Council and indicated she had an issue with <br />the noise being generated from Kelly's and Trio. She then said that she would prefer if <br />Council did not authorize any special permits that would allow outside events to go <br />beyond the noise ordinance time limit of 10:00 p.m. because she has to work early in the <br />mornings and the last event was very difficult for her. <br /> <br />Council Member Capra asked if residents were notified when noise permits are issued. <br />Ms. Moore,Sykes indicated she did not think so. <br /> <br />City Attorney Hoeft indicated that the enforcement issue can be taken up with the police <br />department and said there is no requirement to notif'y the neighbors when a special permit <br />is issued but it is possible once the City determines how large of an area should be <br />noticed. <br /> <br />Mayor Swedberg asked whether the liquor ordinance needed any information on noise. <br /> <br />City Attorney Hoeft indicated that the noise issue would be handled under the noise <br />ordinance and said that, if it is too difficult for officers to apply, Council could review <br />that ordinance. <br /> <br />Council Member Nelson asked Ms. Moore-Sykes to review the noise ordinance and <br />report back at the next Council meeting and also asked her to let Ms. King know whether <br />Council needs to amend the ordinance or not. <br /> <br />Mayor Swedberg said the comments were reasonable and should be able to be <br />accommodated. He then said, if residents need to abide by a 10:00 p.m. time limit, he <br />thinks it is appropriate for other outside activities in the City. <br /> <br />Council Member Travis asked what Council wanted to do about permits. <br /> <br />Ms. King indicated they are notified of a variance but are not notified of noise permits <br />when issued. <br /> <br />City Attorney Hoeft suggested using 300 or 500 feet for notification purposes. <br /> <br />Council indicated they would try to address the concerns when reviewing the noise <br />ordinance. <br /> <br />Page 7 of 18 <br /> <br />L___ __ <br />
