Eagle TraillPioneer Properties <br /> <br />Steven St. George of 1861 Pioneer Lane and Mark Pangell addressed Council and asked <br />for an update of their water situation. Mr. Peterson indicated the individual who was at <br />the last meeting had not provided surveying information as promised. Ms. Moore-Sykes <br />indicated the City had received nothing from him either. <br /> <br />Mr. Peterson indicated he was out there after the meeting and walked down the line with <br />Mr. Palzer and it appears that Mr. Gainers wood railroad ties have a lot to do with the <br />way it is pinched down there. <br /> <br />Mr. Pangell indicated he agreed that those are not helping the situation but noted those <br />were only placed there within the last 30 to 40 days. He further indicated he could do <br />nothing about those railroad ties but has to deal with the water problem caused by them <br />and the townhome development. <br /> <br />Mr. Pangell indicated that residents could clean out the drainage easement with <br />wheelbarrows and shovels but said he is not sure they are qualified to do so. <br /> <br />Council Member Capra asked if the area is sodded. Mr. Pangell indicated it is weeds that <br />are not maintained and there is no sod. <br /> <br />Council Member Broussard Vickers asked whether the homeowner's association was <br />mowing the area. <br /> <br />Mayor Swedberg indicated the bank is very steep and difficult to mow. Mr. Pangell <br />agreed that the bank is difficult to mow and then commented that the whole development <br />contained a comedy of engineering flaws. <br /> <br />Council Member Broussard Vickers asked for the engineer's opinIOn. Mr. Peterson <br />indicated there is no problem with the design. He then said that the drainage way should <br />be more open and commented that the fence is in the drainage way railroad as well as the <br />railroad ties making the whole thing narrower than it should be. <br /> <br />Council Member Broussard Vickers asked if the fence and railroad ties were in the <br />drainage easement. Mr. Peterson indicated it looks to him that they are in the drainage <br />easement but he would need a survey to know for sure. <br /> <br />Council Member Broussard Vickers commented that the City would have the authority to <br />have those items removed if they are in the drainage way. She then commented that the <br />drainage easement cannot be impeded. <br /> <br />Mr. St. George asked whether the area was graded properly in the first place. Mr. <br />Peterson indicated it was not the City's job as the developer had his own engineer design <br />that property.
