<br />City of Centerville <br />August 28, 2002 <br />Council Meeting Minutes <br /> <br />Council Member Broussard Vickers indicated she had heard of no problems or <br />complaints. <br /> <br />Council Member Travis indicated there have been a horrendous amount of complaints as <br />the building permits in the City are much higher than any other City. He then said he is <br />concerned that the building permit fees could be challenged causing an issue for the City. <br /> <br />City Attorney Hoeft indicated that the permit fees need to be related to the expense that <br />the City incurs in processing those permits. He then said that it may be possible to <br />challenge the fees but that challenge would not apply to past fees paid. <br /> <br />Council Member Broussard Vickers questioned the use of the term revenue generating <br />fees. <br /> <br />City Attorney Hoeft indicated that other fees that have been challenged in other cities <br />were fees that were termed as revenue generating rather than actually being fees. He then <br />said that no permit fees are allowed to be revenue generating because that would be <br />considered a tax. <br /> <br />Council Member Capra indicated the City is looking at a large amount of revenue from <br />the permit fees and she has a concern with regard to charging 25% over the Uniform <br />Building Code. <br /> <br />City Attorney Hoeft suggested that Staff should provide information on how the City <br />justifies the cost of its permits for future reference, if it is needed. <br /> <br />Motion bv Mayor Swedberl!:. seconded by Council Member Nelson to direct Staff to <br />proyide an analysis ofthe City's fees by the second Council Meetinl!: in November. <br /> <br />Council Member Travis indicated he would like to have Staff do a comparison with the <br />surrounding communities because he knows the City charges more than neighboring <br />cities for the same product. <br /> <br />City Attorney Hoeft indicated that it may cost Centerville more to provide the same <br />service but said that Staff should provide justification for those fees for review. <br /> <br />Council Member Travis said he would bet that Centerville is the highest in the metro and <br />not by a little bit. He then estimated that the City was charging $3,000 to $4,000 more <br />than other cities on a single-family home. <br /> <br />Mayor Swedberg amended his motion to include an analysis of the Class 7 cities that <br />exist in the Stanton group in the metro area.
