AT&T (Capra) <br /> <br />Council Member Capra indicated that the Commission is looking at approval of the <br />contract at the August 21, 2002 meeting. She then indicated that she would be given a <br />synopsis of the contract and could provide that to Council. <br /> <br />3. 1540 Peltier Lake Drive <br /> <br />This item was handled earlier in the meeting. <br /> <br />4. Commercial Developments Inquirv/Capital Proiects Analvsis <br /> <br />Ms. Moore-Sykes indicated that Staff continues to research the capital projects. <br /> <br />Ms. Paulseth indicated that she is having trouble finding the developer's agreement for <br />Apple Tree Square. <br /> <br />City Attorney Hoeft indicated that often times the prior City Administrator drafted the <br />agreements in house and if that was the case he may not have a copy at his office but said <br />he would look. <br /> <br />Council Member Broussard Vickers said she would like to have the developers billed out <br />if the developer's agreements can be found. Ms. Paulseth indicated she and Ms. Moore- <br />Sykes have had discussions about this with some of the developers and there are concerns <br />with the timeliness of the billing. <br /> <br />Ms. Paulseth indicated that the developers have been given itemized copies of the billings <br />that occurred over the years. <br /> <br />Council Member Capra asked if Council should set a timeframe for response or payment <br />on the accounts. <br /> <br />Council Member Nelson suggested 30 days. <br /> <br />City Attorney Hoeft indicated that it would be necessary to determine when the statute of <br />limitations began running before giving a time frame for payment. Ms. Paulseth <br />indicated that Deer Pass was closed out. <br /> <br />Council Member Broussard Vickers asked Staff to determine the statute oflimitations of <br />the accounts that were closed out. <br /> <br />City Attorney Hoeft indicated that any continuing obligations on the part of the developer <br />would extend the contract. He then said he would review the contracts to determine the <br />statute of limitations. <br /> <br />Page 20 of21 <br />
