<br />City of Centerville <br />October 23, 2002 <br />Council Meeting Minutes <br /> <br />Council Member Broussard Vickers asked how the City would get a cafeteria plan set up <br />by the first of the year if this is not approved. <br /> <br />Council Member Broussard Vickers said she would like to can the question. <br /> <br />City Attorney Hoeft said he has an HR attorney, a labor attorney, and a tax benefits <br />attorney that would need to come to the meeting based on the discussion because he is <br />unsure what exactly Council is asking for. <br /> <br />Council Member Nelson said it would be fine with her to have all three come to the <br />meeting because she feels this issue is important enough to warrant the cost. <br /> <br />Council Member Broussard Vickers asked why this was being asked for at the 11 th hour <br />when at the last work session Council was largely in agreement. <br /> <br />Council Member Nelson indicated that people did express that they felt strong-armed or <br />were not comfortable with it. Mayor Swedberg said he had said he did not like it. <br /> <br />Council Member Broussard Vickers commented that all the people in the world talking to <br />Council would not give the City more options. <br /> <br />Council Member Capra said she did not believe there was an option with deferred <br />compensation until the union contract is negotiated. She then said she agrees with <br />Council Member Nelson and would like the personnel policy reviewed by a human <br />resource attorney but she feels that Resolution 02-045 needs to be approved because the <br />City has no option. She further said she is not happy with the deferred compensation. <br /> <br />Mayor Swedberg asked if there is a reason the City would have to continue the benefit <br />next year if it is given this year. City Attorney Hoeft said not necessarily however, with <br />nonunion employees it may not be an advisable practice and with union employees it <br />sounds like there is an established past practice and, once established, it would be <br />difficult to discontinue a benefit without getting a grievance. <br /> <br />Council Member Capra said that Ms. Moore-Sykes stated that once a benefit is given it <br />carmot be taken away. Ms. Moore-Sykes clarified that she had said that once a benefit is <br />in the contract it carmot be taken away but the City does have the option to renegotiate <br />the contract. She then said that renegotiating on an already provided benefit could be an <br />arduous task. <br /> <br />City Attorney Hoeft asked Council to write down the questions they have so that he can <br />determine what types of attorneys need to be at the meeting. <br /> <br />Council Member Broussard Vickers called the question. <br /> <br />VOTE: Ayes - 3, Nays - 2(TravislBroussard Vickers).
