<br />4.6 System Tests and Inspections; Special Testine:. <br /> <br />4.6.1 Grantee shall perform all tests necessary to demonstrate compliance with the <br />requirements of the Franchise and other performance standards established by law <br />or regulation. <br /> <br />4.6.2 The City and the Commission shall have the right to inspect all construction or <br />installation work performed pursuant to the provisions of the Franchise. In <br />addition, the City and/or the Commission may require special testing of a location <br />or locations within the System if there is a particular matter of controversy or <br />unresolved complaints regarding System construction, operations or installation <br />work pertaining to such location(s). Such tests shall be limited to the particular <br />matter in controversy. The City and/or the Commission shall endeavor to so <br />arrange its request for such special testing so as to minimize hardship or <br />inconvenience to the Grantee or to the Subscribers of such testing. <br /> <br />4.6.3 Before ordering such tests, the Grantee shall be afforded thirty (30) days <br />following receipt of written notice to investigate and, if necessary, correct <br />problems or complaints upon which tests were ordered. The City andjor the <br />Commission, as applicable, shall meet with the Grantee prior to requiring special <br />tests to discuss the need for such and, if possible, visually inspect those locations <br />which are the focus of concern. If, after such meetings and inspections, the City <br />and/or the Commission wishes to commence special tests and the thirty (30) days <br />have elapsed without correction of the matter in controversy or resolution of <br />complaints, the tests shall be conducted at the Grantee's expense by a qualified <br />engineer selected by the City and/or the Commission, as applicable, and the <br />Grantee shall cooperate in such testing. <br /> <br />4.6.4 Unless otherwise provided in this Franchise, tests shall be supervised by the <br />Grantee's chief technical authority, who shall certify all records of tests provided <br />to the City and the Commission. <br /> <br />4.6.5 The Grantee shall provide the City and the Commission with at least two (2) <br />business days' prior written notice of, and opportunity to observe, any tests <br />performed on the System. <br /> <br />4.6.5.1 Test results shall be filed with the City and the Commission within <br />fourteen (14) days of a written request by the City and/or the Commission. <br /> <br />4.6.5.2 If any test indicates that any part or component of the System fails to meet <br />applicable requirements, the Grantee, without requirement of additional <br />notice or request from the City or the Commission, shall take corrective <br />action, retest the locations and advise the City and the Commission of the <br />action taken and the results achieved by filing a written report certified by <br />the Grantee's chief technical authority. <br /> <br />25 <br />
