<br />4.7 Drop Testiul! and Replacement. <br /> <br />The Grantee shall replace, at no separate charge to an individual Subscriber, all Drops <br />and/or associated passive equipment incapable of passing the full 860 MHz System <br />capacity at the time a Subscriber upgrades service to a level which requires a signal <br />above the 550 MHz spectrum. <br /> <br />4.8 FCC Reports. <br /> <br />Unless otherwise required by the terms of this Franchise, the results of any tests required <br />to be filed by Grantee with the FCC or in the Grantee's public file shall upon request of <br />the City or the Commission also be filed with the City or the Commission, as applicable, <br />within ten (10) days of the request. <br /> <br />4.9 Lockout Capabilitv. <br /> <br />Upon the request of a Subscriber, the Grantee shall make lockout capability available at <br />no additional charge, other than a charge for a Converter. <br /> <br />4.10 Tvpes of Service. <br /> <br />Any change in programs or services offered shall comply with all lawful conditions and <br />procedures contained in this Franchise and in applicable law or regulations. <br /> <br />4.11 Uses of Svstem. <br /> <br />The Grantee shall, upon request of the Commission, advise the Commission of all active <br />uses of the System, for both entertainment and other purposes, and the Commission shall <br />have the right to conduct unannounced audits of such usage. <br /> <br />4.12 Additional Capacity. <br /> <br />The Grantee shall notify the City and the Commission in writing, in advance of the <br />installation of any fiber optic capacity not contemplated by the initial design or System <br />Upgrade, so that additional fibers may be installed on an Actual Cost basis for <br />govemment and institutional use. If the City wishes to request additional fiber, it may <br />notify the Grantee within fifteen (15) days of receipt of the Grantee's notification. <br /> <br />SECTION 5. SERVICE PROVISIONS <br /> <br />5.1 Customer Service Standards. <br /> <br />The Grantee shall at all times comply with FCC customer service standards.
