<br />(1) The developer shall install as a part of the site grading a protective screen <br />planting berm in areas deemed appropriate and/or necessary by the City Council. <br /> <br />(2) The plantings will provide a minimum of 60010 opacity year round and shall <br />reach a minimum of 10 feet in height at the maturity. Deciduous shrubs shall be <br />minimum of24 inches in height, deciduous trees shall be a minimum of 1 inch caliper, <br />and conifers shall be a minimum of4 feet in height at the time of planting~ The <br />landscape plan for the berm shall be submitted to and reviewed by the City for approval. <br />. . <br /> <br />(3) All plantings shall be warranted to be alive, of good quality and disease-free <br />for a period of 12 months or 1 growing year, whichever is greater after acceptance of the <br />city streets and utilities. The first planting replacement shall be warranted for 12 months <br />from the time planting. The city shall be entitled to draw upon the security posted herein <br />for replacement of any plantings. <br /> <br />(4) Developer shall not enter into any agreements with the homeowners which <br />provide for installation of the bOulevard trees by the homeowners. <br /> <br />(N) Insurance. Developer(s) and/or all its/their subcontractors shall take out and . <br />maintain, until the city has accepted the private improvements, publk liability and <br />property damage insurance covering personal injury, including death, and claims for <br />property damage which may arise out of the developer's work or the work ofhis or her <br />subcontractors, or by one directly or indirectly employed by any of them. Limits for <br />bodily injury and death shall be not less than $500,000 or more. The city shall be named <br />as an additional insured on the policy, and the developer or all its subcontractors shall file <br />with the city a certificate evidencing coverage prior to the city signing the plat The <br />certificate shall provide that the city must be given 30 days' advance written notice of the <br />cancellation of the insurance. The certificate may not contain any disclaimer for failure <br />to give the required notice. <br /> <br />(0) Costs. Cost of developer's improvements, description and completion dates <br />shall be described in the development agreement. <br />Cross-reference: <br />Erosion Control, see Chapter 155 <br /> <br />1153.44 IMPROVEMENT AND CONSTRUCTION; MISCELLANEOUS. <br /> <br />(A) Streets. The streets shall be graded if required by the Council to the grades and <br />dimensions shown on plans and profiles and approved by the Council, and shall include <br />the following improvements: <br /> <br />(1) Suitable drainage structures, culverts, storm sewers, ditches and related <br />installations shall be provided to ensure adequate drainage of all points along the streets. <br />There shall be no surface or at grade cross-street drainage; <br /> <br />(2) Concrete curbs and gutters will be required on all streets; <br /> <br />(3) The base course shall consist of latest Minnesota Department of Highways <br />approved material, bearing a 7-ton design and shall include a geotextile fabric Diat as <br />specified by the City Engineer; <br /> <br />.
