<br />. <br /> <br />a. Farm: A farm is real property considered to be in agricultural use <br />provided that annually it is devoted to the production for sale ofIivestock, <br />dairy animals, dairy products, poultry and poultry products, horticulture <br />and nursery stock, fruit of all kinds, vegetables, forage, grains, bees and <br />apiary products. <br /> <br />b. Farming: The cultivation of the soil and all activities incidental <br />thereto; agriculture and the raising of livestock and/or poultry. <br /> <br />c. Feedlot: A lot or building or combination of lots and buildings <br />intended for the confined feeding, breeding, raising, or holding of animals <br />exceeding ten (10) animal units (as defined by MPCA Chapter 7020) and <br />specifically designed as a confinement area in which manure may <br />accumulate, or where the concentration of animals is such that a vegetative <br />cover cannot be maintained within the enclosure. Open lots used for the <br />feeding and rearing of poultry (poultry ranges) shall be considered to be <br />animal feedlots. Pastures shall not be considered animal feedlots. <br /> <br />2. <br /> <br />Farm drainage systems, flood control and watershed structures and erosion <br />control devices shall meet all County, State, City, and DNR regulations for <br />the permitted uses of the R-l zoning district. In addition, sump type <br />storage systems for manure, slaughter or butchering wastes of livestock <br />and/or poultry or other systems of animal waste or manure storage that are <br />of like or similar nature are required. These uses and systems shall <br />comply with all applicable regulations of the Minnesota Pollution <br />Control Agency.(MPCA) to prevent feedlot runoff. <br /> <br />{ <br /> <br />3. The feedlot area, confinement building, or manure storage <br />area shall have side and rear yard setbacks of 500 feet from any <br />existing non-farm building or dwelling. <br /> <br />b. The feedlot area, confinement building, or manure area <br />shall have side and rear yard setbacks of250 feet. <br /> <br />This suggested language comes from lsanti County. I contacted the cities of Hugo and <br />Lake Elmo regarding their experience with slaughter houses or butcher shops. The City <br />Administrator indicated that from their experience, following their ordinance regarding <br />these types of uses helped them to regulate the use. The City Administrator from Lake <br />Elmo reported that his city has never had to deal a slaughter house or butcher shop <br />request. <br /> <br />The property that was involved in the original request for a slaughter house is currently <br />being considered for purchase by another buyer. If this sale goes through, the developer <br />is proposing to rezone the parcel to commercial and R-2A and the proposed uses will <br />more closely match the current uses in that area. As such, the Council could decide at <br />this time to allow the moratorium to expire. Staff would recommend that Council <br />
