<br />~ <br /> <br />. <br /> <br />Definition: Discrimination is defined as any overt or covert behavior that excludes <br />access to, admission to, full utilization of, or benefit from any public service because of <br />race, color, creed, religion, gender, age, national origin, sexual orientation, marital status, <br />veteran status, age, public assistance status, or disability. <br /> <br />Discipline: Employees who participate in discrimination of any kind are subject to <br />discipline, up to and including termination. <br /> <br />Policy: In keeping with the City's commitment and the reqnirements of the law, the <br />City and staff will strive to remove any discrimination in the treatment of customers, <br />employment, assignment and promotion of personnel, training programs, services and <br />opportunities offered to citizens and staff, location and use of facilities, and in verbal <br />and written communications. <br /> <br />Complaint Procedure: Employees can bring complaints, ask questions, and raise <br />concerns under this policy without fear of reprisal. <br /> <br />(A) An Employee who believes he/she has been made the subject of any <br />discrimination or who believes he/she has witnessed discrimination should <br />report the incident immediately to his/her supervisor. The employee's <br />supervisor shall then immediately notify the City Administrator about the <br />complaint. <br /> <br />(B) If the contact with the immediate supervisor does not prove effective, or if the <br />problem is with the supervisor, the Employee may at his/her own discretion, <br />by-pass the immediate supervisor and submit a written complaint directly to the <br />City Administrator. <br /> <br />(C) An Employee should report the complaint in writing, detailing the nature of the <br />complaint and all events leading up to the situation prompting the complaint. <br />List any witnesses to the event, the time, date and place of the alleged violation, <br />and any other information that may be pertinent to the complaint. <br /> <br />27. SAVINGS CLAUSE <br /> <br />This policy is subject to the laws of the United States and the State of Minnesota; in the event <br />that any provision shall be held to be contrary to law by a court of competent jurisdiction from <br />whose final judgment or decree no appeal has been taken within the time provided, such <br />provision shall be void. All other provisions of the policy shall continue and remain in full force <br />and effect. <br /> <br />46 <br />
