City of Centerville <br />City Council Meeting <br />May 27, 2009 <br />Councilmember Lee stated that he agreed with Councilmember Paar. He added that <br />Northland has a substantial history with the City, and they also did a lot more homework <br />than the others regarding what the City needs. <br />Mayor Capra, Councilmember Broussard Vickers and Councilmember Fehrenbacher <br />concurred and stated that they would also vote for Northland. <br />Motion by Council Member Broussard Vickers, seconded by Council Member <br />Fehrenbacher, to appoint Northland Securities as Centerville's Financial Consultant. <br />All in favor. Motion carried unanimously. <br />5. Peltier Lake Drive - Change Order #2 <br />City Engineer Statz stated that his change order presented at the last meeting was not <br />agreed to by the contractor. He reported that the price for open cut was higher. The <br />revised change order was the directional drilling price. <br />Motion by Councilmember Lee, seconded by Councilmember Paar, to approve <br />revised Change Order #2, as recommended by City Engineer Statz. All in favor. <br />Motion carried unanimously. <br />VII. NEW BUSINESS <br />1. Consider Agreement for Testing Services (Soil & Etc.) - 2009 Street Project, <br />American En in.~ eerin T.~ esting, Inc. <br />City Engineer Statz stated that this has been discussed over the past few months. Most of <br />the firms have tried to limit liability, but the City objected. The only firm that did not limit <br />liability was American Engineering Testing. In the future, the City should consider <br />adopting that language as its generic language and encourage other firms to accept that <br />language. City Engineer Statz stated that he is very comfortable with American. He stated <br />that they are excellent at what they do, and their prices are reasonable. <br />Councilmember Lee inquired whether other cities allow companies to limit liability. <br />City Attorney Glaser stated that this is an upcoming trend. <br />City Engineer Statz stated it is because at one time a lot of engineering firms were being <br />sued. <br />Motion by Councilmember Fehrenbacher, seconded by Councilmember Paar, to <br />accept the Agreement for Testing Services (Soil & Etc.) - 2009 Street Proiect, <br />presented by American Engineering Testing, Inc., with the condition that the City of <br />Centerville is listed as an additional insured under Commercial General. All in favor. <br />Motion carried unanimously. <br />Page 6 of 11 <br />
