<br />Effective 9/5/00 <br />City ofCenterville Ord. #4 <br /> <br />spaces and public and recreational facilities have been constructed and provided, he shall <br />forward this information to the City Council, which may revoke the PUD Permit. <br /> <br />Section 180-270: Maintenance of Common Open Space. All land shown on the Final <br />Development Plan as common open space must be conveyed to homeowners association <br />or similar organization for the maintenance of the planned development. The common <br />open space must be conveyed to the homeowners association or similar organization <br />subject to covenants to be approved by the City Council which restrict the common open <br />space to the uses specified on the final development plan, and which provide for the <br />maintenance of the common open space in a manner which assures its continuing use for <br />its intended purpose. <br /> <br />Section 180-280: Homeowners Association. If a homeowners association is created, <br />the applicant shall submit plans at the time of final plan of development and documents <br />which explain: <br /> <br />A. Ownership and membership requirements; and <br /> <br />B. Articles of incorporation and bylaws; and <br /> <br />C. Time at which the developer turns the association over to the <br />homeowners; and <br /> <br />D. Approximate monthly or yearly association fee for homeowners; and <br /> <br />E. Specific listing of items owned in common including such items as <br />roads, recreation facilities, parking common open space ground, and <br />utilities. <br /> <br />Division 185: Variances <br /> <br />Standards <br />The Planning Commission shall recommend a Variance and the Council shall order the <br />issuance of such Variance only if it conforms to the following standards: <br /> <br />A. Special conditions and circumstances exist which are peculiar to the <br />land, structure, or building involved and do not result from the actions <br />of the petitioner; and <br /> <br />B. Literal interpretation of the provisions of this Ordinance would deprive <br />the petitioner of rights commonly enjoyed by other properties in the <br />same district under the terms of this Ordinance; and <br /> <br />C. Granting the Variance requested will not confer on the applicant any <br />special privilege that is denied by this Ordinance to other lands, <br />structures, or buildings in the same district; and <br />Page 55 of 62 <br />
